but all signs are pointing to the fulton county da to being very agressive to do this.which makes sense she's an elected official, and is concerned about this apparent crime in her district. >> senator graham's legal team says they are planning to challenge this subpoena. his attorneys are saying, they were informed through their discussion up to this point that graham is quote neither a subject nor a target of the investigation, simply a witness, end quote. does that make sense to you? that he wouldn't be suspended as a target? is that how it usually works, that he would be suspended? that he's a witness? >> yes, he would. what's unusual is why he wouldn't cooperate. so i actually, ana, as i am a practicing lawyer. i represent clients all the time who are suspended pursuant to government investigations. i usually am trying to figure out whether ply client is a subject or a target versus a witness. if my client is a witness, i'm usually happy to bring them in and cooperate with the interview. why not? there is not as much of a downside, if they don't have liability for

you spoke with the fulton county d.a. what more are you learning about these target letters? what was in them and what was in them, and the fallout? . >> well, yeah, first of all, this is an extremely important development in this investigation. i mean, willis has been the most aggressive prosecutor investigating donald trump and the conduct of his allies after the 2020 election. she's been far ahead of the department of justice in pursuing potential witnesses. and with this latest development, target letters to those who participated in that fake elector scheme on december 14th at the state capitol in georgia, as well as in other states, trump electors met in secret, behind closed doors, kicked the press out, and anointed themselves the bona fide electors from the state of georgia to send to the national archives and to the u.s. congress, providing material -- grounds for vice president pence to reject the real electors who were voted in by the voters and substitute these trump electors. as we reported today, willis has sent target letters to at least some of those fake elec

tanya miller is a former fulton county assistant da, federal prosecutor, and is running unopposed for georgia state house. she joins me now. great to have you on. first, the giuliani ruling from new york judge seems like a good development for the fulton county da perspective. >> yes, and i think what's most interesting about that is that he didn't even bother to show up at the hearing. it does not seem like he put up any meaningful fight to have that subpoena actually squashed. no judge is going to squash the subpoena if you don't even show up. explain why you think the subpoena is overly burdensome, or perhaps you were not served by it or your information is not particularly relevant to the investigation. all the things that are available for you to argue that you have been subpoenaed, it did not seem like he came to court himself to do that. and so we don't know if the court denied the subpoena based on that, or based upon the merits of the arguments that he could've made. but essentially, what we know is that rudy giuliani needs to show up in fulton county, and appear before the c

you also note this about fani willis, the fulton county da, you notice the -- snow into play here, butns to the justice department and others that this investigation is happening. she is, you know, sent the starry letter to those fake electors, including a state senator named brett jones. the republican candidate for lieutenant governor of georgia. he could face indictment on monday. a judge in spirit court barred her from pursuing a case against mr. johns because she had headlined a june fund-raiser for her democratic rival -- one of 16 pro trump alternate electors in georgia. i thought that is interesting, just because obviously fani willis is a more easier political target i would imagine for people that want to defend trump, and perhaps the department of justice might be as these investigations go forward? >> look, being a local prosecutor is just a different thing then being a u.s. attorney or working out of the justice department in washington. you know, at times, a lot of local prosecutors are elected and, you know, folks of the justice department are appointed or their career p

but it's also big news because it is a major escalation of this fulton county investigation. today, fani willis said she is considering whether to call donald trump himself to testify before the grand jury. joining me now is going keys fleming, former district attorney at dekalb county georgia. thank you so much for being here tonight. help us understand this for a moment. the importance of these target letters procedurally, both for da willis and for the recipients of these letters, if a kind of special grand jury district attorney, willis, has convened does not have power to issue indictments itself, is it unusual that the district attorney's office has sent these targets letters to these individuals warning them that they could be, in fact, inducted? >> it's not unusual and it used to be a very common practice back when the law in georgia said that any elected official that is being investigated by a state special grand jury would have the opportunity to present a sworn statement and not be question before the grand jury. the law has changed since then. and so now elected

michael isikoff reports for yahoo news, quote, fulton county georgia district attorney fani willis has sent so-called target letters to so-called to prominent georgia republicans, informing them they could be indicted for their role in a scheme to appoint alternate electors pledged to the former president despite joe biden's victory in the state, according to legal sources familiar with the matter. isikoff is reporting that a number of people on the receiving end of those target letters are prominent georgia republicans, including state senator robert jones, governor brian kemp's running mate for lieutenant governor. david schaffer, the chairman of the georgia republican party and state senator brandon beach. both jones and schaffer reportedly participated in the fake electors scheme that trump and his allies cooked up as a way to float the results of the election. the washington post previously obtained an email that was sent out by the trump campaign to the fake trump electors. the email said, quote, i must ask for your complete discretion in this process. your duties our imperative

the fulton county special grand jury also subpoenaed other lawyers, all of whom worked with trump aslled this year to assist fulton county district attorney fani willis' information into whether there were any coordinated attempts to unlawfully alter the outcome of the 2020 elections in georgia. among the incidents that willis said she is investigating, a november 2020 phone call that graham made to georgia secretary of state brad raffensperger. raffensperger said that graham pressed him about whether he had the power to reject certain absentee ballots, which raffensperger interpreted as a suggestion to toss out legally cast votes. graham denied that's what he was trying to do, calling the allegation, quote, ridiculous. joining us now national correspondent for the washington post matt brown. welcome to the show. let's talk about how these investigations differ from what the january 6th committee is trying to do and what's our sense of it, those targeted by subpoenas yesterday, graham, giuliani, et cetera, do we have any anticipation they will comply? >> yeah, that's a really good qu
