gaige grosskreutz, he lies to. so at this point, the crowd is dealing with what they perceive to be an active shooter, someone who has just shot someone, who is still in possession of the gun, who is fleeing the scene. and how are we supposed to know where he's going next? you know, all night that night, the crowd has been hearing the sound of gunshots. they've been hearing fireworks, firecrackers. but now someone actually has been shot. the crowd sees the defendant running with a gun. he's lying to them. he still has the gun. he's shot someone. this is provocation to them. this is someone who has committed a criminal act and is putting people in danger. it is entirely reasonable for that crowd to believe at that moment that he is a threat to kill again. the defendant could have made it unequivocally clear what he was doing. he could have stayed at mr. rosenbaum's body, helped protect him, help preserve his life, call 911. as he's running, he could have announced to the crowd exactly what he was doing, told them. h

he put the tourniquet on gaige grosskreutz. he testified that he had his ar-15 with him providing medical services, first aid, just like kyle rittenhouse. i find it so ironic that he was there, gaige grosskreutz had said to them, go home, we have our own medics, you stooges. who ultimately helps him with his tourniquet? sarah hughes, her testimony, he reminded mr. huber and his girlfriend that they needed to be home by curfew. obviously not advice that was followed. wish i had been. carry and skirt. i talked about. she talked about joseph rosenbaum being bipolar, being prescribed medication. he had to leave her house after night after walking four miles, talking and an hour and walking another four miles back to downtown where the riots were going on where he could involve himself fully. her story contradicts nathan debruin. he said i just got out of jail and i'm not afraid to go back. he got off his meds the week prior. the videos of joseph rosenbaum show the state that he was in. no proof that he ever took his meds. the first

and you heard gaige grosskreutz testify about that. about how that is a decision that he was not prepared to make at that point in time. he's not the type of person willing to take someone's life in anyone an stand, unlike the defendant who took two lives that night, very quickly and seemingly very easily. there is a video, exhibit five, which is the bg on the scene video which traces this entire incident which we call the second event. this is going to show you mr. huber, mr. grosskreutz and the other individuals trying to stop an active shooter using what i would characterize as the least intrusive mean s possible. someone knocks his hat off. thoern huber comes in with a skateboard. in just a few seconds the defendant kills one person and attempts to kill two more and blows off gaige grosskreutz' arm. it's that fast. this someone who has no remorse. no regard for life. only cares about himself. and these folks that are coming at him, the jump kick man, anthony huber, aren't armed. they're not a credible imminent threat to his life. t

gaige and kimberley, thank you both for joining me. gaige, i want to start with you.r two men he shot that night died. with rittenhouse taking the stand, what did you think of his testimony? >> i think any time you see your would-be murderer on the stand it's emotional. >> what was your reaction to him breaking down and crying on the stand? >> to me it seemed like a child who had just gotten caught doing something that he wasn't supposed to. more upset that he was caught and less upset about what he had done and what he had taken and the numerous lives that he affected through his actions that night. >> and, kimberly, as gaige's lawyer, what is your take on what we've seen and heard in the courtroom so far? >> well, i think that it should be recognized that, mr. rittenhouse was an active shooter and that it's important i believe that, as gaige has said, that some of his testimony was extremely inconsistent. you know, he was not, i believe, in imminent fear of danger for his own life. gaige acted and, you know, he was not threatening mr. rittenhouse. mr. rittenhouse re

anthony hubert, joseph rosenbaum, and gaige grosskreutz. the 27-year-old survivor we heard from yesterday the testifying injured by rittenhouse. of course, kyle rittenhouse has claimed it was all in self-defense. he's pleaded not guilty. he's been testifying about that day in august of 2020. testifying that one of the men shot and killed, threatened to kill him twice. rittenhouse testified that he was pepper sprayed by someone in the crowd. and we should point out that if you've been listening and heard offensive language as rittenhouse testified about what he saw and heard the day he shot and killed those two and injured a third in kenosha, we apologize for the language you saw and heard. gabe gutierrez is on the ground in kenosha. he's been following this trial from the beginning. paul henderson is also with me. paul, veteran prosecutor. and the executive director of the san francisco department of police accountability. gabe, this is that moment that we were all waiting to see and hear. kyle rittenhouse taking the stand in his own defens

rittenhouse's other victims, joseph rosenbaum and gaige grosskreutz. to be clear, the juror has decided he did not commit murder, that he indeed was acting in self-defense, which is what the defense had presented to them, the prosecution obviously fighting against that. we, you know, we expect to hear from some more of these families. we expect to hear from the -- at least the attorney potentially for gaige grosskreutz who was severely injured in this, and who did take the stand. his testimony paramount in this case, as well as all of the video that this jury had and could watch as many times as it wanted. there was a lot of consternation by the defense in letting this jury watch the video, you have to be careful putting so much onus on one piece of evidence. the judge being very clear, that may apply to witness statements, but that should not apply to video that shows the action that they are deciding. it shows the very moments of these killings, and so the jury did so. they did take a look at the video again, and their decision was that he was not gu

did jump kick man or gaige grosskreutz? none of them. did they pose a threat to his life or cause great bodily harm. the standard when you make this decision is what a person of ordinary intelligence and prudence would have believed in the defendant's position under the circumstances that existed at the time of the alleged defense. the reasonableness of the defendant's beliefs must be determined from the standpoint of the defendant death of the defendant's acts and not from the viewpoint of the jury now. so put yourself in the defendant's position. would you have done the same thing? would a reasonable person have does the same thing? would you have engaged in the reckless conduct that led to this course of events? would you have gone out after curfew with an ar-15 looking for trouble? would you have aimed at other people and tried to use the gun to protect and empty car lot? no reasonable person would have done these things. the court has instructed you on provocation. you cannot hide behind self-defense if you provoked the incident, if

gaige grosskreutz testified what he heard he heard i didn't shoot anyone and gaige grosskreutz actedthat. he then followed -- he left mr. rittenhouse, thinking that he was not involved in the shooting, and started going to the shooting of mr. rosenbaum before being told by others that saw it that he was the shooter and then he returned. so, gaige grosskreutz relied on the statement of mr. rittenhouse. we're talking -- let's talk about a rush to judgment. mr. rittenhouse turned himself in. he is supposed to be days, weeks, months to charge murders who we know murdered people? it's a red herring as mr. binger said. it's throwing up red herrings, false hypocritical arguments and attacks on those that mr. rittenhouse killed to try to distract you from the fact that he was not in fear of death or great bodily harm and he was not privileged to act how he did. we heard from ms. carrie ann schwartz. now that talked about jail now we can smear mr. rosenbaum more even though there was no dispute that he came from a hospital. he is carrying a hospital bag. ms. schwartz testified that she talked

that was gaige grosskreutz that was shot in the arm. he also said that he pointed his pistol at kyle rittenhouse. that was how their interact began, which a lot of people thought the trial could have been over in that moment. andy, the question of whether or not the prosecution sort of went too far in the way they charged this case. first degree reckless homicide and that first -- in the first count with regard to the death of joseph rosenbaum. and i thought it was interesting. goes on down the line. five counts. the option for second degree counts in some of these as well. i watched mark richards closely as you see them listen to this verdict. you could hear a pin drop. everybody is holding their breath as we wait for this verdict. i'm looking at mark richards's face. he buries his face in his hands. he said i was a little bit afraid because of the amount of time the jury took that they might have bartered. in essence that they might have chosen one count here or there to find him guilty on. so of course, the not guilty, the first and

>> yes. >> you intentionally used deadly force against gaige grosskreutz, correct? >> yes. >> reporter: but then, the prosecutor began to talk about the timing of rittenhouse's testimony. after rittenhouse has had a chance to hear others testify in this trial, and seeing video of the night's events. the judge interrupted citing rittenhouse's fifth amendment rights. >> the problem is this is a grave constitutional violation for you to talk about the defendant's silence. >> so, the questioning continued. but this time, touched on a previous incident the judge had not, as of wednesday, allowed into trial. the judge had had enough. >> the court left the door open. >> for me, not for you. >> i was astonished when you began your examination by commenting on the defendant's post-arrest silence. that's basic law. it's been basic law in this country. don't get brazen with me. >> reporter: the incidents prompted the defense to file a motion for mistrial with prejudice, meaning he could not be retried. the judge said he would take it under consideration, and the prosecution re

and he wanted to get gaige grosskreutz's word out.didn't repost and say he lied but he took it down, but unfortunately, the internet has a memory. the next witness was kyle rittenhouse. we did recall the brothers but i've talked about that. kyle rittenhouse did not have to take the witness stand to tell his story. it was told through video. he wanted you as the jurors to hear his personal experience of the night of the 25th. he knew mr. binger would cross-examine him for hours. he was willing to get up on that witness stand, take the oath and tell his story the best way he could. and he did. could mr. binger pick on him and find little things about it? a little bit. did he damage his credibility? i don't think so. getting to mr. yellowpants, which he's been talked about. mr. binger talks about, he says with sarcasm, ladies and gentlemen, you've seen the video, but remember, that when the yellow pants said to kyle, he goes, you held your gun like this. that's low ready. that's not like this. it's down. he never pointed his gun at him.

gaige groskreutz was also shot but survived. shimon prokupecz has more on that. >> reporter: initially yesterday the judge told the jury that he was thinking that the trial would end by monday or tuesday. today he came into court and said i was kind of confused about the day of the week. now i'm thinking this perhaps could wrap up tomorrow. what exactly that means is unclear. perhaps we would have closing arguments tomorrow. then he would send the jury home, charge them on the law and maybe deliberations would start on monday. it's not entirely clear. the defense is really pretty much wrapping up their part of their case and they could rest sometime this afternoon. they've called three witnesses. one of them, as you said, is a use-of-force witness talking about the sequence of events, the timing between the shots that kyle rittenhouse fired. there was a police officer that testified about shell casings that she herself found. finally, a witness on the stand who took some video. there's some issues about the video that he took. t

joining me now is the lawyer representing gaige grosskreutz. i have so many questions.t now that he took your -- took the stand, your client took the stand and recognizing that both kyle and he were there for very different reason sreasons, for event. what is your take on this? >> well, thank you for having me. actually my client went to kenosha, wisconsin, simply to serve as a medic, he provided medical services for both sides, for people that were pro police and those protesting on behalf of jacob blake. i think that's the difference. and my client actually lived in the state of wisconsin, which is a significant difference. >> that is -- thank you so much for clarifying that. i do want to ask you, one thing we found quite interesting was that there is an idea of charging rittenhouse with less charges, and that technically they could be charged separately these two incidents of the shooting. could you elaborate on that and what is the likelihood? >> well, it is common, frankly criminal practice for prosecutors to ask for a lesser included jury instruction once all the

rittenhouse's other victims, josen rosenbaum and gaige grosskreutz. he was shot but did not die. his bicep was blown off and he did take the stand in this case. we should also mention that the mother and father of mr. huber, anthony huber, were not in the courtroom watching all of this and they explained why, they could not take the emotional toll from sitting in trial however members of anthony huber's family were there. his aunt for example was in court watching all of this the machinations of this court and waiting for the jury's discussion. but you hear there from a family who felt that their son was trying to do something valiant and they feel like justice was not served here. you'll hear the complete opposite from kyle rittenhouse, his family and his attorneys who feel that kyle rittenhouse as the jury also decided was innocent of all of these shootings and did so in self-defense. i do want to talk to you a little bit about some of the things that we learned in this case while the trial was going on. that was not public knowledge or whats not widely known publicly. one of t

gaige grosskreutz was injured. the situation, immediately politicized. the left jumped on rittenhouse as the face of white hate. the white made him the poster boy for white fright and self-defense. but now at the trial notions of left and right must stay outside and all we know is what can be made as reasonable by the prosecutor. we only know what the prosecution can show. in the instant case, that means can the prosecution show that rittenhouse is guilty of murdering and injuring beyond a reasonable doubt. now, the surrounding circumstances are not helpful to rittenhouse. he claims he was at the protest to help, to provide medical support. but he was posing as an emt. he's not one. and he brought an ar-15 he wasn't allowed to have, two place he was not from, with no right or authority to protect any property. now, he says the property owner asked for his help. that is not what the owner says. nevertheless, for the jury, the key part is likely not why he was there, but whether it was reasonable for him to shoot three men in self-defense. early notions we

rittenhouse's other victims, joseph rosenbaum and gaige grosskreutz. we did not attend the child because we could not bear to sit in the courtroom and watch videos of our son's murder. we watched the trial closely hoping it would bring us closure. they say, that did not happen. today's verdict means there's no accountability for the person who murdered our son. it sends an unacceptable message that armed civilians can show up in any town, incite violence, and use the danger they've created to justify shooting people in the street. that's, again, from the family of anthony huber, the 26-year-old. and one piece of context for this is, anthony huber was the man reflected in the fourth count of this case, the most significant count, and it was that first degree intentional homicide. again, what is considered first-degree murder in pretty much any other state. i think it underscores the pain that you have from the families of those who were shot and killed by mr. rittenhouse, by kyle rittenhouse. of course the jury is saying that was justified, they acquitt
