two hours later the same camera captures gary giordano banging on the doors of the rum reef restaurantthe bar and patio, looking for help. aruban authorities have been poring over the surveillance videos for a month, wondering, if in this one, giordano exhibited the kind of urgency expected from someone who just lost his companion. and studying this grainy surveillance image, the last of robyn gardner, who giordano said likely drown off this isolated beach while they were snorkeling. but so far, neither these images or the transcripts of giordano's allegedly suspicious phone conversation with am/ex insurance agents have given prosecutors enough hard evidence to charge him with any crime. and for the first time one of giordano's girlfriends sits down and breaks her silence about the last time they spoke. she asked that we protect her identity. >> he actually e-mailed me the day she went missing. hey, how are you? is everything okay? i e-mailed back and didn't get a response. i called him. and he told me he was in the middle of something. >> reporter: just two months before he took robyn

i can't lose faith. >> a judge in aruba ruled that gary giordano can remain in jail for another 60 daysain, still no sign of robyn gardner. >>> a pharmacist confronted by armed robbers on the job is now suing walgreens. he was fired for fighting back. surveillance tape shows the moments when two masked men, gunmen burst into the store, one guy leaps over the counter, pointed the counter at jeremy hoven working the night shift. the point is he had a weapon, too. john, how did it play out? >> reporter: well, craig, this is where it happened at this walgreens here in benton harbor. two men burst in, 4:30 in the morning. one of the men held another employee at gunpoint with the gun in his back. the one who leat over the counter not only pointed the gun, he pulled the trigger three times but for some reason the gun didn't go off. hoven told what happened next. >> i feared for my life, and in self-defense, i fired my weapon as i continued to move from him. >> he was exercising his reasonable right of self-defense in the face of a gunman who attempted to pull the trigger three times and shoot

he's meeting with gary giordano right now in aruba, and we know that gary has been held for quite some with the disappearance of his then-girlfriend that went with him to aruba. t.j., it's really interesting. because we know that jose baez can't practice law to aruba. legal system is really different. apparently he's been retained just in case there's some sort of legal proceedings that might take place in the united states. who would hire jose baez? people hate him just as much as they hate casey anthony. so, a jury is likely to hate him as well and perhaps, you know, sort of transfers those feeling on gary giordano. another school of thought, perhaps now jose baez is making a name for himself as the attorney that takes on people that aren't necessarily guilty. for those people who perhaps think that casey anthony is indeed innocent of the charges. even though we know that she was found not guilty. he's making a name for himself as the go-to attorney. when you're in big trouble. the case against gary giordano, at this point, looks pretty significant. >> for people -- >> you're looking

robyn gardener has been miss tpoerg six weeks now since going on a trip with gary giordano. ived in aruba on july 31st. days later giordano reported she had gone missing. they claimed they were snorkeling when she was suddenly pulled away by ocean currents. on august 5th giordano was arrested before boarding a plane. it was then refield that investigators had discovered giordano tried to cash in on an insurance policy, a travel insurance policy some time after her reported disappearance, a policy that named him as the beneficiary. and on september 7th giordano was denied release from an aruban jail. today investigators are reenacting giordano's version of the drowning in the day, honing it might bring hem closer to either gardener, or the truth. joining me now former dc homicide detective and fox news contributor rob wheeler. have you ever heard of this before. >> yes, megyn it's not unusual for the police especially in a homicide case to try and reenact the final moment of the decedents, or the person that is missing their moments of life. what the police are trying to do ri
