there is no legislative authority for the court to gell perspective cell tower information. we have used for years what's been called the hybrid order. back in 2005 or so, a couple magistrates wrote opinions in which they wrote that legislation was unclear. in the absence of clear legislative authority supporting the use of this reasonable suspicion-like standard, they were going to require a warrant based on probable cause. those opinions spread like wildfire. almost overnight, you went from getting information to not being able to get it without a warrant. so i will explain why that is important in a molet. -- moment. using the g.p.s. knowledge in your phone, as far as i can remember, and i was a prosecutor for 15 years, starting in 1999, as far as i can remember, we have been required to use a warrant. that may be a surprise if you watch any show that's ever aired on c.b.s., but that's the rule. you can't just get it by being jack bauer and punching something on your smart phone. have you to get a warrant to get g.p.s. information from someone's phone. that has been the r
