with us now is texas attorney general ken paxton who supports the order.d morning, nice to see you. only one mayor is changing in court. here's one of his arguments. >> the tenth amount of the constitution says that the federal government cannot specify how local governments must go about enforcing federal law, yet that is exactly what the president's order does. >> that was not in your state, my mistake. it was in the city of seattle there. what do you say to that? >> it's federal law. they're obligated to follow the law. we have a bill based on the same problems. we have a sheriff who will not enforce federal and state law and we're concerned about the safety of our citizens. >> i want to question you about the safety in your cities. are you worried that the immigration laws will erode trust, people within immigrant communities and thereby thwart theable for police fighting crime and trying to get thing done in those communities? >> my greater concern is the fact that the sheriff is releasing illegals who have been convicted of crimes in the community wh

cheryl: here now to react, ken paxton, texas attorney general. , great to have you here on this issue. you know, secretary kelly said yesterday, reiterated this today, in that news conference that the border keeps him up at night. he is worried about the southern border and security there. at same time there are republicans along the district in texas want a delay on the wall. they're concerned about the funding and how it will be constructed. what are you hearing? >> i can tell you somebody in the legislature for 12 years, now ag, this has been a concern of mine and many others for many years. the fact that secretary kelly is concerned about because is sort of music to our ears. we've been waiting for an administration to do something about it. the questions there are questions about this from other republicans, i have i don't have a problem with questions, i i he a problem with inaction. as long as there are questions, a lot of good questions to be asked about everybody. as long as there is progress, people of texas will be happy. cheryl: michae

joining me now texas attorney general ken paxton. an overnight fight wednesday into thursday in texas over the contours of this bill. one of the things i thought was interesting is there would actually be a mechanism to remove elected or appointed officials if they violate the ban on sanctuary cities. the president's ban didn't survive the federal court in a ninth circuit. texas is a different place. do you think the bill survives there? >> i do. it's state law, not federal law. we're dealing with state law. something we've been trying to pass for several years. the governor has been very behind this and behind the provision you're talking about which creates penalties for elected officials that don't follow through. >> shannon: how much is there an issue in sanctuary cities in texas? you have people of all different ideological backgrounds. what's the problem like for you? >> quietly an issue. travis county we have a sheriff saying she wouldn't turn over people to the federal government. she has made it a bigger issue than it would

texas attorney general ken paxton joins me now here in new york city. mr. o be here in new york. stuartdid i get that right? you passed law, and if a sheriff doesn't go along with it, he or she is in jail. >> potential criminal penalties. it was passed by the senate first about a month ago, and the house last night at three am passed a similar bill. so, yeah. stuart: doesn't this take direct aim at the lady who is sheriff of travis county which is part of austin? >> i would say she was an inspiration to us all. she was an inspiration for this -- stuart: it's aimed at her. >> well, i mean, it changed in the house. that provision wasn't in the house until last night. i think the senate adopted it because the governor saw what was going on in travis county and in austin, and he wanted to address it, and that's what they did. stuart: governor greg abbott says no sanctuary cities in texas, we don't want it. however, president trump's executive order banning federal funds going to sanctuary cities, that's been held up by a judge in california. does that hold up yo
