we're live here in fremont, george kiriyama, nbc bay area news. >>> the mother of a 5-year-old redwood city boy allegedly kicked and deprived of food by a special ed teacher wants more than a million dollars in damages. cortes took the first step to suing 44-year-old alexia and several district officials by filing at the redwood city school district. the teacher at roosevelt elementary school pulled her autistic son's hair, kicked him in the stomach, and also prevented him from eating and drinking water. she has not pled guilty to the criminal charges in the case. the school district declined to comment on today's claim. >>> the latest national job numbers are out, and they are ugly. the labor department says only 69,000 jobs were created last month, well below what analysts expected, raising the jobless rate to to 8.2%. what about the bay area? our business and tech reporter scott budman finds locally there's both struggle and strength. >> reporter: the latest employment numbers held two stories in the bay area. >> the opportunity here is very scarce. >> reporter: for unemployed teach

george kiriyama joins us with more on both fronts. >> reporter: it was his second time in court. and again no plea. sierra lamar's family also was not there today. but they have plenty of support outside of the courtroom. antolin garcia-torres entered the courtroom, with a black shirt, handcuffed and a serious face. he went before a judge and did not enter a plea. that was postponed until july. outside of the courtroom, 20 volunteers showed support for sierra. she's angry he won't reveal where. >> it shows he has no heart and has no emotion. he has children of his own, obviously, how would he not empathize, you know, for the parents, what they want for their little baby girl. >> reporter: the girlfriend of garcia-torres was in the courtroom but would out in talk to us. sierra lamar was last seen march 14th in morgan hill. they found dna inside the suspect's red jetta that matches sierra's dna. legal experts say this will be a difficult case to prove. >> absence of a body. absence of a crime scene. absence of a murder weapon. there's a lot of things that the prosecution has to put

nbc bay area's george kiriyama has more on the developments in court. george? >> the trial had a lot of twists and turns. the latest one, the judge in this case sent the jury home and said to come back on monday. tonight we talk to the attorney pat harris who said he wants the case dismissed. >> he committed perjury on the stand. no question that even the prosecutor himself said he was abused. >> father joe testified wednesday he did not molest will lynch 35 years ago, but he is not on trial for sex abuse and he is now the alleged victim. will lynch is now charged with beating a priest at his home in 2010. pass harris said he wants the case against his client to be thrown out. >> here now committed perjury which he did on the stand on thursday. i think this case should have never come to court and should be dssnow. >> the defense will ask for a mistrial and dismissal. >> for will be interesting to see how he continues to testify or if he would invoke his privilege that protects him from incrimination. >> all of the testimony will have to be stricken and the jud

george kiriyama is live in gilroy. >> reporter: schools are feeling the pressure, so are the cities. tonight in gilroy, they're talking about a sales tax for schools. but the majority of the city council department like it. we're being taxed too much. susan rodriguez told the city council. and the majority agreed. turning down a sales tax for the schools. >> we can't be taxed further. >> reporter: the school district was asking gilroy to use a sale tax for schools. the measure, which would have appeared on the november ballot, would have increased sale tax by a quarter or half cent. >> we decided to take a proactive approach. >> reporter: that approach can be seen on the state level, where voters will be asked to improve a tax increase that would increase tuition for students. but the money will only be there, if the regents agree not to raise fees. he's disappointed the issue won't be decided by the voters. >> we don't have the programs we used to. we have to let the citizens decide what they want. >> reporter: but neighbors like suzanne rodriguez say the sales tax would have killed

george kiriyama joins us from the santa clara police department with more. >> reporter: the woman who was attacked is a student. we talked to other students near campus tonight. and they admit, they're looking forward their shoulders now. >> the street is pretty busy during typical weeks. since it was finals, it was pretty dead. >> reporter: dead and quiet. most students were studying or sleeping when a woman in her 20s said he was attacked walking on bellny street on tuesday morning. >> it's scary she was assaulted right where everyone walks every, single day. >> reporter: santa clara police investigators say two men saw her walking alone. one of them grabs her. she was able to wrestle herself free. >> the victim, completely frightened. very upset by this. >> reporter: santa clara university sent out an e-mail to all of the students just hours after the alleged attack. >> makes me really nervous. you know? it kind of opens up your awareness. >> reporter: the incident has made some rethink walking home alone. >> it doesn't make me want to walk it anymore. which is why i ride my bicycl
