gillian turner leads us off tonight. good evening, julian. >> good evening, so president trump's former national security advisor general michael flynn has asked an appeals court to force a district judge of handling his case to drop criminal charges against him in a brand-new emergency filing, they ask that judge emmet sullivan handling the case dropped the charges. they say he is not objective and is creating a political spectacle. in the midst of a national collection season, drag them into the political hurricane. now his legal team also insists he would be removed from the case and the court immediately called his unusual move to allow a friend of the court, a.k.a. a specially appointed judge to argue against a justice department's request to drop the case. flynn is not the only former national security advisor making headlines tonight. fox news has learned the acting director has declassified a top-secret inauguration day email written by susan wise. president obama's top foreign policy advisor and send it over to

gillian turner, what are you picking up there in washington? >> good afternoon to you. so picking up on the list because that's the latest thing you're talking about, lots to unpack here. the first thing that jumps out at us as of the former vice president joe biden is on the list, kind of an unexpected move. but aside from that, going over the members on this list, it all appears to be mid-level to top-tier level obama administration officials. a lot of these folks are not political appointees, a lot of them are career civil servants who served in democratic and republican a ministrations over years. one of them, lieutenant durrant general douglas lute served in the bush administration on the iraq policy issue. he went on to be the wars are for iraq and afghanistan for president obama. he then even served at the beginning of the trump administration so this is somebody who, you can't really shove him into one particular corner are or another so that's an important kind of point here when we are laying the groundwork. you can't say that all these people are liberals or

the email that rice sent to herself was puzzling, up until a few minutes ago when fox news' gillian turnerent out a note to say the reason she sent that email to herself the afternoon of the inauguration is because the outgoing white house counsel neil kristin asked her to document what happened. and, vice president joe biden on his thoughts. with russian ambassador kislyak. comey said that could be an issue. he was saying the nsa should not pass. flynn has pacified information from costly act but he also noted the level of medication is unusual. white house officials zeroed in on that language thus far since that memo has been released saying, that new administration, the investigation of flynn was going to continue. that email suggested that director comey didn't see any evidence of "thus far." we will just keep digging until we find evidence. that's a disgrace. every american should have this chill in their stomach that that could be done. ambassador rice did not alter the way she briefed reichel flynn on russia as a result of director comey's response. there was an investigation of mic
