not only the commission and the city -- and i really want to commend general manager ginsberg -- ginsburg and his entire team for working with us. we are honored to continue to forge forward and use this model as a model that can be used in other community parks. we know 20 years ago, the city was in a similar economic time to where we are today. we compensate the city back dollar for dollar for our gardener, and we have built a $2.5 million endowment that will insure that this sanctuary will forever remember and honor those lives lost. thank you. commissioner buell: thank you very much. that i think is the nature of the - >> let me turn to that, justice ginsburg. the -- two points about that. the first one is that as we read this court's recent decision in humanitarian law project, the question on the fifth amendment analysis of whether there is vagueness and arbitrary enforcement has to be answered by reference to the specific broadcasts at issue here. in other words, was there fair notice with respect to these specific broadcasts? and i will get to that, but i -- but let me first go directly to your honor's more significant question. and i think the -- the problem with looking at the case that way is that the lens is focused too narrowly, in that there actually, when one broadens out the lens and looks at the wide range of decisions that the commission is making about indecency and then broadens it out even further and looks at the wide range of broadcasts that occur, actually the number of broadcasts are -- that have been identified as even raising a question of arbitrariness or inconsistency is a -- is really quite a miniscule fraction. it

earlier, i spoke with mark ginsburg, the former u.s. ambassador about what to expect next.ou have just returned from the region. what is the feeling about what is going to happen now in syria? >> there is great concern that the arab league mission, while it is an important demonstration of unity among the arab members who send troops there, the fact of the matter is that the syrian people themselves have been let down by this mission. the mission has been hoodwinked. it has been led around by the syrian government. they have no teeth to prevent the shooting that has been taking place. to continue this mission without there being a real opportunity to in effect force a cease-fire really almost gives the regime more of a lifeline to shoot. it is the one worm that that -- one word that that regime only knows, to shoot. >> what you are suggesting is that failure has happened. what can happen? where is success going to come from? >> in the absence of having a united nations security council -- because the russians are determined not to take any action against the regime -- all e
