justice ginsburg: how did rbg begin? first i think i should explain what i have in common with the notorious b.i.g. [laughter] it's something quite important. we were both born and bred in brooklyn, new york. [applause] so how did it all start? it all started with the film called makers on pbs some years ago. the two filmmakers portrayed the women's movement in the 1970's, the effort to get the courts to catch up to changes in the way people were living, the effort to get legislation. these filmmakers, betsy west and judy cohn did a fantastic job and it was well-rounded. it included all, even clips of someone who is no longer in this world. gloria steinem, but it also portrayed the people who were anti-equal rights amendment. i admire the film and when the two makers came to me and said that they would like to do a film about me i said ok. [laughter] so, they followed me around for two years. two years. if i went to have a conversation like this, if i made a speech at a bar association or law school, they came with me to

as i mentioned before, they picked ginsburg -- before they picked ginsburg for that seat they had previously been thinking about nominating a judge named anthony kennedy instead. by the next day, though, after this newscast about ginsburg withdrawing, on november 8th, by then we knew that anthony kennedy was already back at the white house. by sunday, that weekend, anthony kennedy was at the white house, being subjected to a three-hour long interview by a whole panel of senior officials, including the attorney general and white house counsel and republican leader in the senate. we know that. we know that kennedy was at the white house being interviewed the day after ginsburg withdrew because of notes filed by reagan's white house counsel, which you can now get from the ronald reagan presidential library. so, the timeline here was on saturday ginsburg dropped out. sunday, the very next day, quote, three-hour interview of judge kennedy at the white house. quote, the interview focused solely on personal background and integrity issues. all conceivable "no holds barred" questions were asked. so

ginsburg dropped out. on sunday, three hours interview of judge kennedy at the white house, quote, "the interview focused on personal backgrounds and all conceivable and no holds barred questions were asked." that was on sunday and on monday and tuesday, quote "in excess of ten hours of fbi interviews of judge kennedy." they were not going let the douglas ginsburg happening again. they never asked him if they had done drugs. these are some of the questions, personal background, subsection one, childhood through high school. did you ever use alcohol and if so, how old and how often? at parties? alone? did you ever use drugs? >> did you ever use your parent's prescription drugs? that typo was in the letter. they misspelled parties. later on they asked again when kennedy was in college of questions about alcohol. in college, did you ever use drugs? >> also, marijuana, cocaine and etcetera, did you attend parties, again, misspelled and were drugs used? then they asked him about law school. they thought glue sn

think about ruth bader ginsburg. i think she got through something like 96-3. it's going to be a whole different story for brett kavanaugh. democrats are ready to pounce here because, remember, that kavanaugh is taking the place, if he is confirmed, of justice kennedy and that is going to really cement the conservative majority on this front for years to come and democrats want to fight this as best they can. they say two things. they say he believes in a strong executive and he also says he doesn't think a sitting president should be indicted so some democrats are saying given what is going on with president trump, he should agree to recuse himself from any issues stemming from those investigations that will to the supreme court. they will push on that but is not going to happen. supreme court justices all the time rule on issues that are important to the people that put them on the bench. but the other issue the democrats are also going to seize on are documents and kavanaugh, he has hundreds of thousands of docume

views when she was a nominee, but justice ginsburg was confirmed 96-3. this body has obviously treated some nominees differently since then to the detriment of our courts. i strongly disagree with the senate's treatment of judge garland. judge kavanaugh spoke growingly of judge garland stating, chief judge garland is a brilliant jury jurist, thought, collegial, a good man, integrity. he's qualified with experience for the supreme court. all of this is equally true of judge kavanaugh. i do not think it's fair to hold judge kavanaugh responsible that judge garland is not a justice today. instead i would urge this committee to treat him as we expect to treat litigants that appear before him, on his own merits and with an open mind with someone whose views may differ from our own. our judicial system is not well-served by tit-for-tat politics. at the end of the day i support judge kavanaugh and i'm proud to induce him because he's qualified which extraordinary experience and temperament and does fit within the mainstream of legal thought. i look forward to t

but it is right and proper to embrace the ruth bader ginsburg standard.been embraced by every previous nominee -- by the way, justice breyer was nominated when president clinton was under investigation and it did not slow him down either. what matters most is the character and temperament of the judge and the decisions that they have handed down previous. and on those issues, both character and temperament, not a dplo glove was laid on him. and the democrats didn't even talk about their decisions. the they made a strategic choice to try to turn the absence of the papers into an issue. it fails miserably. every time that they try. they were not prepared to listen closely and go after him. chuck schumer may be under serious pressure to step aside, i think, in the new congress like nancy pelosi, because he has failed to do what mitch mcconnell is effectively. and i think what you saw was the collapse of the democratic resistance in the senate. and i think you'll see at least three, perhaps as many as five democrats vote for brett kavanaugh within three weeks

starting with ginsburg, that i have cited that hearing to say nothing.e always been a critic of it because i don't understand what the purpose of these hearings really are ultimately. >> what is the purpose of them? >> look, the idea behind this is that this is a lifetime appointment. brett kavanaugh is 53 years old. he will sit on that court probably for the next 30 years and will impact all of our lives in ways we cannot even imagine yet there should be a full and thorough airing of what his views are and how he will see the law. i do understand, and that is true of both democrats and republicans. nobody wants to answer specific questions of how they will rule on hypothetical facts or even on existing facts, but there has to be more of a conversation about people's values and legal views than we've seen i think in the last few nominations. >> no one wants that conversation until they're in the minority, right? that's only in a conversation that minority senators want to have. >> michael, do you see this document dump, if that's what it was, as inapprop
