welcome, justice ginsburg. i want to begin by welcoming you back to the very courtroom where in your some 13 years on the d.c. circuit you heard 46 bank cases, 46. of those 46 cases, three, including one you wrote, went to the supreme court. all three were reversed. [laughter] judge tatel: and not only that, the opinion reversing yours was written by none other than your friend, justice stevens. but pardon me-- it was a warrant case. but a powerful dissent by justice marshall, demonstrating that as usual, the d.c. circuit was correct. [laughter] judge tatel: justice ginsburg, when justice scalia gave the lecture some eight years ago, he went forward to judge flannery as a judge's judge, he referred. and i'd like to use that as our theme today and have a conversation with you about the art of judging. do you want to say something about that? justice ginsburg: david, i'm glad to have one of my favorite conversation partners with me, and i would just like to say a word about judge flannery. i had the privilege of

justice ginsburg: yes. mr. kneedler: i think this would qualify under the proposed regulation, as i -as i read it. in fact, it identifies -- it says while the landowner's intentions can be taken into account, it's sort of a sliding scale, and the more critical the particular area is for the species, the less likely it is that the intentions of the landowner would be taken into account. and i think that exactly describes this case. this is a rare case because of the rare nature of these ponds. it is critical to preserve these ponds. and they can be used for the habitat of the species. justice gorsuch: could this -- mr. kneedler: it is the kind of place, because of the ponds, where the species can thrive. justice gorsuch: let's assume for the moment that this isn't habitat and, therefore, couldn't be designated as critical habitat. could the secretary take other actions to identify this land as critical to the survival of the species, even if it isn't currently habitat? is there anything in section 7 or elsewhere

justice ginsburg: but there are standards here. i mean, it's not the attorney general, it's the congress that defines what crimes will require registration, where, and when the individual is required to register, of what information is necessary, and the penalties for failure to register. all that is specified by congress. the attorney general doesn't -- is not at liberty to prescribe when, where, how, what crimes. all that is done by congress. ms. baumgartel: but none of those very detailed provisions of sorna that congress set forth apply to pre-act offenders. the attorney general was given the power both to decide whether the law applied to pre-act offenders and then how it should apply. justice kagan: well, that gets back to the question that the chief justice started with, because it seems that there is some language in the statute that supports the government's reading, that this is a statute that basically says register all pre-act offenders as far as possible, with some understanding that there are feasibility consideration
