tony kennedy and ginsburg were in the majority but it's an interesting question i think it does relate back to the civil rights hubris and when the court was making the ships and a footnote in the decision and those of us who went to law school who studied this protecting minorities is held out as a constitutional bar in a way that ordinary regulatory legislation does not and this is undergird in the constitutional theory and this is part of the democracy descendents would have you so this sort of thinking is somewhat embedded in our constitutional law but it's a good question because when it comes to the big tease of economic legislation like obamacare and like the affordable care act you have folks like john roberts and in fairness john roberts defended it and marriage as well. >> one of the things you take two cases and compare them. one is jack phillips and isolated thinker says i don't want the bigger wedding cake with same-sex marriage. their templates as round the corner that you can go to and i'm happy to supply you and this man in the most savage terms available death threats.
