the president's renewed push to close gitmo once and for all.op lawmakers are working on a bill that would halt the president's ability to transfer gitmo prisoners. the worry that these detainees will eventually return to the battlefield. the five yemeni prisoners are suspected al qaeda fighters captured in pakistan. years they're being transferred to two different countries, oman and estonia. defense officials say it is no longer necessary to keep them behind bars. doug mckelway with the latest on our top story today. doug? >> reporter: after that firestorm that erupted over the failure to send a high level delegate to the uppity march last week and release of five yemeni prisoners from gitmo will just add fuel to the fire. the former chief medical sister says at gitmo says none of these five should have been released. >> not one detainee that i would let loose at this point. there is no way that you can win a war on terror by releasing detainees. it doesn't make any sense. >> reporter: in a system that accompanied release the defense departmen

my next guest to and who is left at gitmo.50 to 80 detainees who have either direct yemeni connections or from yemen, and now as you know, yemen is to put it mildly in great unrest. what do we do with them? if the administration is that trot to get them out of gitmo one middle ground is send them to another country. what is to stop them when they get in the middle east to go back in. >> there's nothing to step them. thew prisoners or let prisoners lose before the end+u g of the war, they go back into the fight. we know in the past that yemen;ñá may go in the front of door of the prison about go out the back doctor and get back into the fight now. we don't have good real estate with yemen, there's nothing to guarantee they don't go back into the fight. this stems from the president's eagerness to close gitmo. once the place is empty of prisoners he'll say, we might as well close gitmo. the problem is they're going back into the fight, and as long as they are in the fight, whether you want to call them terrorists or armed insurg

so why does the president want to close gitmo? with me now, fox news contributor john bollton, one of our favorites. why does he want to release these people? >> well it's been an i'd logical obsession of the president from the days of his campaign in 2008. you know, he doesn't believe we should have a war on terror. he thinks it should be treated as a law enforcement matter. and gitmo is a symbol that his predecessor at least was waging a real war on terror. >> i don't want to interrupt you but you say he wants to treat it as law enforcement. be my guest. try them for something. don't just release them. >> yeah. well, it goes beyond that because he's not simply turning them over to prison facilities in other countries. he's basically letting them go. and i think in addition to the etiological -- it's six years that he ordered gitmo closed in one year. it's a palpable failure of his administration. i think there's something deeper. i think this is a prerequisite of the president actually turning gitmo back other to cuba. >> all ri
