i would like to thank supervisors mirkarimi and his predecessor, matt gonzales, under both of whom is the district 5 up 20. our last motion was an alert to the supervisors about the library's very bad priorities. as of the committees last meeting in february, the library administration had proposed and advocated for a $500,000 cut in the books and materials budget. even as overall spending on other things was to grow by $2.2 million. i'm glad to say that thanks to this motion and additional efforts by my own group, library users association, the library withdrew its cuts. the first partially, and then, fully. that is good, but it is not good enough. the priorities that place books after other matters need to be examined very closely when you see the library budget and act on it. let me read you the resolution. well, senator, i think the court actually grappled with that very issue in the subsequent case, the gonzales, where they were opposed with a similar characterization issue as to whether or not marijuana grown in the use for medicinal purposes purely within local boundaries qualified as a kind of activity that could be reached under the commerce clause. and there i think the court made an accommodation. it said that though this is non-economic activity, it longs to a class of economic activity. and so i'm not sure exactly where that leaves us, but the rule that emerges from raich seems to be that non-economic activity that belongs to a class of economic activity is reachable under the commerce clause. and so i think that the only point of the book was to suggest that definitionally these things, like all distinctions in the law when you press very hard on them, there are gray edges on the distinctions. but in the main i think these are workable in the role that i would be filling if i were confirmed. >> in the wake of gonzalez v. raich and setting aside for a moment the exceptions identified

gonzales, for five minutes of questions. >> thank you very much, mr. chairman. welcome, madam secretary. i do want to address a comment that was made by a fellow texan that the uncertainty that is out there regarding the constitutionality of the mandate and wondering what the texas attorney general has to do, he's wondering what he has to do as well as our governor, rick perry, what those two gentlemen also represent me, and i do have a suggestion as to what they could be doing in the meantime. they could be coming up with a solution to make health care insurance affordable for texans. so that employers have access to it at a reasonable price to offer it to their employees and that texas, its citizens, have affordable insurance products available to them. so that we don't lead the nation in the uninsured. that's what they could be doing. that's just a suggestion. i'm sure they've thought of it. we've heard that the american people want us to balance the budget, reduce the national debt, and we all agree, and i think the president's fiscal year 2012 budget places
