this is a grassley-kirk amendment number 1299. and i'm having a difficult time getting it put in place so we can get it brought up. i believe there's a lack of understanding of what my amendment does and i think i'll take this time to explain it so you fully understand it and i can get it to a roll call vote. i want to thank senator kirk for joining me on this amendment as a cosponsor. this amendment would address language in the bill that creates a convoluted and ineffective process for determining whether a foreign national in a street gang should be deemed inadmissible or be deported. i offered a similar amendment in committee because i believe this to be such a dangerous loophole that requires closing. my amendment even had the support of two members of the group of eight. specifically, in order to deny entry or remove a gang member, section 3701 of the bill requires that department of homeland security prove a foreign national, one, had a prior federal felony conviction for drug trafficking or violent crime. two, has knowledg

grassley: i reserve the right to object but i will object. i want the members of this body to know that i very much am interested in everify stuff because i have legislation in for mandatory everify, i was involved with several senators in 2007 as we tried to get an amendment -- a bill put together in 2007, and -- in those negotiations. and it's a case of something very important, and i happen to support this amendment. but it's one of 34 others that we sent over to the majority to give us votes on. our side isn't going to let the other side pick our amendments and choose our amendments any more than they would let us decide what democrat amendments are going to be offered. so that applies to the portman amendment as well and the amendment -- tester is a cosponsor of it. so we had this set up where we were asked to put together amendments, it happens to be that a republican senator, somebody that just spoke, involved in this colloquy, asked me to put together some amendments. so i worked hard with a lot of dissenting republicans about how we

circuit court of appeals all but daring republicans but grassley to stand in the way and know this. we are talking about a major political fight here. the d.c. circuit court is known as the second highest court in the land and for good reason. two-thirds of the court's case load involve the federal government in some civil capacity far more than any other appeals court in the country. it's also known as a feeder court to the big bench. four of the current nine supreme court justices previously served on the d.c. circuit court. so let's get real about what's happening here. it is not an overzealous staffing plan. it's the potential of a lasting and meaningful legacy left by president obama long after he leaves office that they seek to stop at all costs. joining me now is a panel chalked full of experts on this topic. carol frederickson. and we also have a law and political signs professor at yale university. we have nan, president of the alliance for justice. lovely to have you all here. so start by telling me why the d.c. courtney hazle of appeals important. they're not doing thing.

last week, senators mitch mcconnell and chuck grassley accuse the white house of court-packing. the term court-packing harkens back to the day of fdr. president obama is of course not expanding the number of seats, he just wants to fill the empty ones. weirdly or perhaps not weirdly at all, not a single republican accused president george w. bush of court-packing when he appointed justices to the d.c. circuit court. if the wild transparently partisan assertions do not succeed in keeping the president it doing his job, chuck grassley, has lately been pushing a bill called the court efficiency act. which would completely eliminate the three seats the president is trying to fill. because, hey, for the second highest court in the land. who needs a full bench, anyway? it's not likely to matter to republicans that the president's three nominees are all highly qualified lawyers and graduates of harvard law, or that with more than a third of the nation's judicial seats sitting empty, the country is facing a judicial emergency. it won't matter mostly because this is a crisis of their own

senator grassley has been a champion in the fight to end h-1b abuse. that is why i'm proud to join senator grassley in our bipartisan amendment to introduce the h-1b and l-1 visa fraud and abuse prevention act of 2013. the h-1b program should only be used when there is no qualified worker available in the united states. that's clearly what the american people overwhelmingly say they want, that the program should only be used when there's foe qualified worker available here. this amendment would increase protections to workers by requiring that employers only hire h-1b workers, as i said before, when there's no equally qualified or better qualified american. this amendment would make sure that a worker from wuhan won't be hired rather than one from ohio. it means employers will seek out american workers before seeking visas for foreign workers. but that's not included in this version of the bill where debating on the senate floor, in this version of the immigration bill. the bill in its current form says companies have to look for qualified americans. i

grassley: i have no problems with this amendment.ensures that tribal communities are represented. the bill's task force is a new and independent entity designed to provide recommendations about immigration border security. mr. tester is adding four additional members to the task force to ensure the tribes are represented. however, this amendment doesn't fundamentally change the bill. there is really no opposition to making sure that the tribes have a voice in policy. of course this task force doesn't have any real power. it only makes recommendations. the secretary isn't required to address their concerns or enact their recommendations. too often the secretary doesn't take into consideration our recommendations. even now she has a hard time in implementing laws. again, while the amendment is noncontroversial, members should know this task force is a fig leaf for actual border security. mr. leahy: i ask for the yeas and nays. the presiding officer: the yeas and nays have been called for. is there a second? there is a sufficient second
