we know that last month two of the top aides to vice president mike pence, mark short and greg jacob appear before the grand jury for testimony under subpoena. but this particular subpoena, really putting the former white house lawyer in the hot seat before the grand jury, this will really put to the test any of trump's executive privilege claims. we know the doj is gearing up for what could be a big court fight. no one is above the law, including the former president. we're really seeing several aggressive moves by doj to get people who are close to trump around january 6th to talk to a grand jury. it does show prosecutors are looking into trump's actions when it comes to the fake elector plot, the capitol attack itself. it's all on the table for doj. >> can cipallone use executive privilege to avoid answering some questions? >> he can exert attorney/client privilege and executive privilege. you have the president of the united states who's an individual and also a candidate for office. what's the relationship of the white house counsel for all of those things? you have to work that

remember, they already interviewed marc short and greg jacob and now they want the two pats. last week we had reports that do skrchlt was trying to block the claims of executive privilege the reason why is to get at trump's communications. why do you want to get to trump's communications? not so you can indict rudy giuliani, although that may happen, but to investigate the former president. also to put water on this, it means that an indictment of donald trump is not imminent. because when you litigate issues of executive privilege, that normally comes at the beginning of an investigation rather than the end. >> how do you see that playing out in terms of executive privilege here? >> i think that doj will steam roll any attempts at claiming executive privilege because executive privilege doesn't apply here. i mean, first off, executive privilege is within the realm of the current president not the former president. but also as the courts have made clear, executive privilege is not designed to conceal a criminal conspiracy. there is a crime fraud exception especially when it d
