greg meyer testified for the defense at the trial of officer mehserle. >> he's mentally trying to draw taser, which is in a cross-draw position over in front of his belt but his hand is on his side arm. so he raises himself up and then fires the one shot. and then immediately reacts you know oh, my god. >> reporter: officer mehserle was convicted of involuntary manslaughter. the jury finding he'd acted recklessly but not intentionally. >> slips and capture can happen when officers rely on old habits and when training is limited. in the b.a.r.t. case myers says the officer had only drawn his taser about ten times during training. yet had drawn his firearm about 50 times each week. plus, without enough tasers to go around the officer was using a completely different holster configuration every night. slips and capture has come into play before. in 2002, in madera california a suspect was shot with a gun after trying to kick out the window of a police car. the police officer said she meant to grab her taser. the suspect died. the officer was never charged. in 2008 in nicholasville, kentuc
