here with reaction, fox news legal analyst gregg jarrett, harvard law professor alan dershowitz. why do i think we're going to get a not guilty verdict tomorrow? am i overly optimistic? gregg? >> no, i think you're absolutely right, because this case comes down to one word justification. if the jury finds that daniel penny acted reasonably in restraining somebody, threatening to kill passengers, then the doctrine of justifiable homicide requires a complete acquittal. these jurors, they're diverse. they're. well aware of how perilous the subway is in new york. and they heard from the passengers who were frozen in fear and panic. they thought they were going to die. jordan neely menaced them and vowed to kill them. they were grateful that daniel penny protected him. and the law says that if you're allowed that you are allowed to use lethal force. if you honestly believe that others are in imminent danger of serious bodily injury or death, even a mistaken belief is justifiable. so the witnesses and penny himself support the defense. but there's another reason, and that's cause of dea

here with insight, fox news legal analyst gregg jarrett. ate investigator. i guess i have never seen this done before. once the jury has reached some sort of verdict. if it's hung or not, then that's pretty much it. the judge issues a ruling. either they retry the case. something was different in new york. why? >> well, it was improper, lawrence, for alvin bragg's prosecutors to suddenly decide to drop the top charge of reckless manslaughter after spending 8 weeks telling the jury that penny was guilty of it and, you know, the judge let them get away with it. he shouldn't have. and, in doing so, the judge contradicted his own ruled that the jury could only consider the lesser count if they found penny not guilty of the top count. well, that didn't happen, did it? so, now, the judge is telling the jury oh, forget about the law. forget about what i told you. his ruling also violates the new york procedure law. that forbids dismissal at this late stage during deliberations unless both sides agree 9 defense didn't agree so, you know, lawrence, i

joining us now with more harvard law professor emeritus alan dershowitz and fox news legal analyst gregg jarrett. gentlemen, thanks for joining me again tonight. important issues here we're facing gregg. i want to start with you. at first, i think at first blush that this dismissal of the manslaughter charge seems like good news, but to the point that this is what bragg perhaps wanted is what's interesting to me. can you explain that to the viewer? >> well, it is a partial victory for the defense that prosecutors threw in the towel on the top charge that they should never have brought. and then the judge dismissed it. but in doing so, judge wiley, i think, created what looks like reversible error so that if the jury convicts on the lesser charge next week, it would be overturned on appeal. why? because the judge contradicted his own earlier ruling that the jury could only consider the second count if they found penny not guilty of the first count. well, guess what? that didn't happen. so now the judge is letting the jury do what he said he couldn't do, and the defense is right. this is coercive,
