let's get the greatest from griff jenkins in texas. griff? griffwe're outside of the sheriff's office in kenny county because just miles from the border where you normally see me in eagle pass they have seen a triple in the increase in the human smuggling cases. take a look at this video shot from saturday. this is texas dps here pursuing a white van. they pulled them over, rescued six migrants being smuggled. the driver was from houston. he admitted to the deputies that he was being paid $2,000 for this particular smuggling case and the sheriff here, brad coe says he's seeing not only an increase in cases but he's seeing smugglers that are armed. he says that he used to be back in the day about one smuggler a month had a gun. now, he's seeing two-to-three cases a week. that's why when we asked him what he thought about that meeting between president biden and obrador he was disappointed there wasn't more of an emphasis or any plans with regards to what's going to be done to cut down on the cartels and the human smuggling and human trafficking. now

apples and oranges. how they handled it was different. but to the "wall street journal's'" op-ed, the perception about handling classified materials is the basic part here. >> yeah. i mean, that is the legal principle at play. and the initial democratic and white house defense was that there was just, what, 10 documents now we know there is more lieutenant journal garland u.s. attorney appointed by trump to do the initial investigation. so it does seem like there is some momentum for a special counsel to have the same standard in how he did he want with the trump administration documents as we're learning that there are very strong similarities between this case and what happened at mar-a-lago. >> bret: you heard the chairs of the senate and the house intelligence committee. both have concerns that they haven't been briefed on any of this, the mar-a-lago documents or this and there's a call for a special counsel in this. i would be interested to see if that happens in this administration. >> i think it should. i really think it should. because, you know, you just talked about, you know, garland knowing about fairness and it would be fair to do it. also, right now, you have the american public not thrilled with the doj and the fbi. and when you look at the american public's perception, their perception is their reality, if you have a special counsel for one president and you are the attorney general under a democrat president and not going to play by the same rules. that's a problem. i have heard a number of republicans say and it's not a headline that biden did nothing wrong here but one thing i think the white house did wrong is because they did report it right away, they contacted their attorneys, national archives doj put it out there we found these get in front of it. >> bret: there's this thing that happened in between the midterms. it was discovered before the midterms. we don't find out until after the midterms and that's a part of the story too, ben. >> ben: i appreciated the fact that he had o'keefe from cbs was so tough on karine jen pierre today on exactly that point there is the perception that you played politics with this we get caught up in the processing of it. the problem is the illegality of it. if you're going to go after donald trump for violating the letter of the law in any kind of respect as it relates to this kind of thing, then you have to have the same level of investment when it comes to the then former haven't and now president of the united states when it comes to his handling of similar materials. there cannot be a separation in terms of how seriously we take these different things. >> bret: last thing on this. here is jonathan turley on the documents investigation. >> his job is to protect national security first. >> right. >> not his legal status. but, also, sort of has that -- almost reminiscent of the hillary clinton documents. remember the white water documents suddenly appearing outside her office and everyone is saying surprise. and that's where it was left. you know, obviously, this is more serious because these are highly classified documents and so we really do need try to sort of reverse engineer on who brought them in. why, and who saw them. >> bret: and with the house control of those committees, one would think this is going to be investigated. >> yeah. it's going to be a central part of house republican oversight. the timing of this, too, is very interesting in that the clinton emails go back to the 2016 election, that was right before the election comey had a very high profile press conference. we do know that biden, this happened two days before the midterm elections. the white house chose not to disclose it obviously putting politics ahead of the transparency. >> bret: this comes as the president wraps up this trip to mexico and to the border. here's the white house on that today. >> he has done more than any prior president to secure the border and build a safe, orderly and humane immigration system. he went to the migrant center which was a critical place to be. there happened to be no migrants at the facility at the time that he visited. he is going to continue to call on is for congress, republicans to actually take action and really deal with this crisis -- this issue. >> bret: didn't want to call it a crisis at the end there, leslie. he went down to the border but the question is what has happened up and to this point and what they are asking congress to do. >> couple things timing on what you said if i may real quick. it is for me sorry for the grassy knoll here. second set of documents speaker confirmed and republicans take over the house timing on that. timing on the border i had said prior to president biden being elected once he was elected and certainly when he appointed the vice president you got to get down there. you have to see it with your own eyes. you have to see what's going on. some of griff jenkins starts off with coverage of the president's visit. he has live in eagle pass, texas on the border, hey griff. took cocktail or good afternoon for that live shot we could go back to the drone, that is exactly what ranchers, property owners and border patrol officials all along this sector in del rio once a president biden to see, the makeshift shipping containers of barbed wire line the banks of the rio grande to try to stem a tide of migrants which has exceeded 4.4 million encounters since joe biden took office on january 20, 2021. and they numbers in just the first 100 days of this fiscal year 2023 which began on octobee stunning part let me show you those pre-taking a look at this eric. more than 718,000 total encounters along the south west of border they are of which hundred 98000 were expelled under title 42. that means more than half a million and 100 days have been caught and released into the united states in hopes they may claim asylum and disappear into the shadows. now, in el paso specifically were present biden's right now we can show you in these 100 days of this fiscal year, there have been more than 168,000 encounters. that is up you see in the middle of the screen, 222% compared to this time last year. the bottom number are the got a ways. more than 78000, meaning officials saw them cross but were not able to bring them into custody. they have disappeared into the united states rate we do not know who they are, where they are from where they are going or what their intentions are, that is the number that really concerns border patrol officials. let me show you some video which is shot a few hours ago of a group that crossed just behind me. this is about 25 migrants from nicaragua, guatemala, columbia. they are made up of family units, some with small children and a lot of single adult males. that is the concern of the numbers that common day and day out. as you look here you can see them just under that bridge. they are being transported border patrol officials complaining they do so much transporting of migrants and processing and not enough of being on the line as they say trying to deter them. that is the great hope the president will put policies in place that will do more enforcement. not just the processing as you see here. that also may have to include some political will on capitol hill that republicans and democrats can come together to pass some sort of immigration reform. one democratic congressman damar said there's probably going to be some will but it will be costly, take a listen here. >> we need to distinguish people coming in for economic reasons and people who are really fleeing persecution. he sang okay people need to file this application online so that before they come. now congress needs to do is provide the resources for people to process the asylum claims for the border security. that is something congress has to do pre-people's eyes are going to cost money? yes is going to cost money. quick speaking of money, one final thought, air, as we see president biden tour migrant shelter in el paso. when you are in el paso, eagle pass, mcallen or del rio the ngos and the catholic charities that have run these migrant shelters are absently tapped out of money, space, and resources. that is why this has been such a crisis for so long, eric. >> i think so. listen, this is the fourth time i've been in eagle pass this year, and i've got to tell you, i don't see a whole lot of other reporters down here except back in june where governor abbott came and held a press conference, there was a little more coverage, obviously. but i think now you're going to see more, already some of our competitors we've seen reporters across from el paso. and el paso leads the nation right now in terms of the total encounters in just the first 100 days, some 168,000 encounters there along with 78,000 gotaways. these are real numbers. it's not debatable, they're hard numbers, and the border patrol officials will give them to all the networks if they'll simply show interest. and i think that if, indeed, this white house wants to get serious about immigration reform, then every network, every newspaper, news organization should get involved as well so that we see everything as it is lined up so they can start addressing it whether it be enforcement or paths to citizenship for the 11 million illegals here in the country already. howard: right. wherever the president goes, obviously, the television cameras follow. so my question is, will this be a two-day story and then biden's checked the box and the press just moves on, or will there be a reckoning on in the, particularly with a republican house, that will force the media to do what you have been doing? >> well, that's the $64,000 question, howie, for sure. and as you were sort of covering in the last segment, you know, the president's being attacked from the progressive left about this new border policy and, of course, being hammered still on the right with the situation out of control. so does it become politically untenable and the administration ryes to walk away from from it?
