if they never decided griswold whether it would have come out of the same way, i don't know that i wasthen on the district court doing my best to follow what i thought was the supreme court's decision and information for the future. so after thinking about it long and hard i thought it was a close call then and still is. i would say personally as a strong advocate to the reproductive choice, roe v. wade should have upheld the very profoundly important. one of the questions i ask supreme court nominees and others to the court are whether they will continue to uphold it and so i think that the reasoning even though it has been criticized remains very important and despite medical advances, which have created issues also. if you talk about the viability medical science is going to progress into the plaintiff viability is going to come closer to the conception. and i do have the opinion that would happen. >> host: that was the principle of the fourth amendment. it is the underpinning as it was for your opinion into the court's opinion. let me ask about the court of appeals in your contribu
