. >> reporter: multimillionaire tech whiz gurbaksh chahal showed off his penthouse digs in this video on oprah several years ago. prosecutors call this a crime scene where chahal beat his girlfriend. a convicted batterer still able to avoid prison by making a deal. punishment fit his crime? >> well, i don't believe so. >> reporter: prosecutors said the video made in his bedroom allegedly shows him dragging his girlfriend from the bed to the floor kicking and hitting her. 117 times over 30 minutes. he faced 45 counts of battery and false imprisonment. then the case started to unravel. >> very high-powered attorney was hired for her and then she became unavailable to us. >> reporter: hired by whom. we don't know. >> reporter: and the judge threw out the video evidence. >> because we were left with no witness and no video. >> reporter: that has to anger you? >> it's disappointing. it's disappointing on many levels because we know this is the kind of case where you know you have significant levels of domestic violence. >> reporter: he avoided years in state prison and got 52 weeks of dome
