savannah guthrie is "today's" legal correspondent.ood morning. >> good morning. >> this new development, three psychologists evaluate casey anthony. what is a competency hearing? >> this is to determine whether the defendant, casey anthony, understands the proceedings happening against her and whether she's able to assist in her defense. normally, this is kind of see you see at the outset of the case. it's pretty unusual to see it in the middle of the case. sounds like it's the defense that asked for this. perhaps something had been going on behind closed doors with casey anthony that led the defense to think, boy, we better ask the judge and ascertain whether or not she's able to go forward with these proceedings. the judge ordered an evaluation from not one, not two, but three different psychologists, all of whom concluded she's able to understand these proceedings against her. note, though, this issue of competency is not about whether she's upset. it's not about whether or not she's got some mental issues. it's a very narrow issue

savannah guthrie is "today's" legal correspondent.ou both. >> good morning. >> savannah, the prosecution has been trying to build a case against casey anthony based on circumstantial evidence. based on what you saw in the courtroom tuesday, was the defense successful in punching holes in the case? >> yeah. the defense got a real opportunity because of an error by the prosecution on a key piece of evidence -- this air can that supposedly had air samples from the trunk of the car. prosecutors allege it will smell like death. that crucial piece of evidence was misidentified in court which made them call back their key witness the second day to clear up the mix-up. in some sense it's a clerical error but in a trial it was an opportunity for the defense. they were able to say, you know, you don't have any expertise in handling forensics, do you? it's another piece of reasonable doubt that kerry sanders mentioned. it's an opportunity the defense will make the most of. yesterday and i suspect in closing arguments. >> and you believe that cas

savannah guthrie, good morning to you. >> good morning. >> you listened to the tapes. very clear why the defense didn't want these admitted into this case. >> no question about it. now what the jurors are seeing and hearing in real time is casey anthony tell lie after lie after lie. this is important for two reasons. not only does it raise questions about what the real truth is, what she's trying to hide, remember, in order for the jurors to buy the defense's theory that this was an accidental drowning they have to believe one person only. that's casey anthony. at this point, she has no credibility with the jurors. >> reporter: as you look at the split screen with her father, george, on the left taking part in this conversation, keep in mind that the defense is putting forward a theory that george discovered caylee's body in the swimming pool and then helped cover up the fact that she drowned. this is the defense's idea. does anything that was recorded in the tapes back them up on that based on what george says? >> not so far. not only that. during the police interroga

she's here along with savannah guthrie, "today's" legal correspondent. it was an emotional day in court. in terms of swaying the jury, how important are the 911 calls to the prosecution and the defense? >> for yesterday when you're the defense you suck it in, suck it up and say, oh, my god. however, when the jury starts to listen they will say, how did this advance the case? did it tell us whether there was an intentional homicide or was it an accident? as a matter of fact, if you look at cindy anthony's reaction to possibly leaving the pool ladder and it not being up or down or wherever it was, one can argue maybe she's having that reaction from guilt. maybe she understands what's going on and it's what the defense contends or maybe she's grief-stricken. >> if you look at the reactions of the women to 911 tapes, cindy seems so distraught listening to them. casey, far less emotional, to say the least. i thought it was interesting. kerry said the jurors never looked at casey which was interesting to me. the difference in their demeanor, how might it affec
