i'm joined by our legal correspondent, savannah guthrie, and by joann reed, who we just saw in ron's report. she's the manager editor of our companion website and a contributor on msnbc. savannah, beginning with you, this case, if they're going to put one together, has now lost several weeks. what is the legal consequences of that? >> it's the lost hours after this crime happened because there may have been forensics that were there that police didn't identify or pursue. this person was able to walk away in the clothes he was wearing. if there's any kinds of ballistics or forensics, gunshot residue, that's lost forever. police didn't do a pointed interrogation that may have elicited some statement that could ultimately have been used. there are lost hours, lost pieces of evidence. it doesn't mean they can't build a case. it's probably now on a better track. you have an independent prosecutor who has come in who has all of the ability to use the state investigators who are very experienced in florida, and you have the federal government watching this very closely. very unlikely there

we're here in guthrie, oklahoma. guthrie was the first state cammca capital here. it has oil that is produced here and piped here. this is a state that's been disa poidisa -- disappointed about this administration's view on the keystone pipeline. this would be a transfer point. it would go down through the gulf of mexico. so they want a pro-energy candidate. most of the republicans have a strong pro-energy platform, so there isn't a lot of policy differences separating the voters here. many of them like rick santorum. like i said, this is a socially conservative state. they find themselves in line with rick santorum's views, but a lot of them really don't like president obama. i heard some of them talking about an abo policy, anybody but obama, so somebody going into the polling booth saying they will vote for somebody as long as it's the person most likely to defeat president obama. like i said, there are democrats in this state, and there are some people voting for the other candidates, but it seems to be the polling and other people we talk to that it comes down

. >> we begin coverage with chief legal analyst savannah guthrie. walk us through the highlights. >> okay, so basically the court was considering what the obama administration would consider the dooms day scenario which is that the individual mandate requiring every individual to get some minimal level of insure suns struck down. the question before the court this morning is what other portions of this 2700 page law could survive if the individual mandate was struck down. we heard three different positions on that. paul clement who represent states says look, if you throw out the individual mandate you are basically gutting the heart of the law and you might as well just get rid of the whole thing, let congress start from scratch and fashion a new healthcare reform law. the government takes what you might consider to be a middle position. they say, if you throw up the individual mandate or we hope you don't, then you have to also throw out the band on denying coverage because of preexisting conditions. they say, those two are part and parcel, they g

and our legal correspondent savannah guthrie is here with us in the studio for more on this tonight. so, savannah, as a lawyer yourself and a watcher of all things supreme court, i'm already seeing graphics in the newspaper about how this is going to be decided. would we be misinformed to think this is going to fall down traditional lines? >> well, a lot of people suspect this will be a sharply divided court along the idealogical fault lines, but not necessarily. this case really boils down to whether the federal government exceeded its power under the constitution in regulating in this area of health care. there have been some other recent cases in recent years that presented similar questions of whether the federal government had exceeded its authority and some of the court's most conservative justices, scalia, chief justice roberts, actually voted to uphold the federal law. in other words, they turned down the opportunity to limit the federal government's power. if you go on that, they could vote to uphold the health care law, but as any watcher of the supreme court knows, sometim

. >>> time for some analysis, our legal correspondent savannah guj guthrie here with us again in the studio. so last night you and i talked about whether the conversation and the votes are going to come down along party lines. today the questions sure seem to. and a lot of people say, this court doesn't ask devil's advocate questions. it may be an indicator. >> i'll be the devil's advocate on that. oral arguments are not always an indicator of where the court will come out. i mean, actually, if you look at the lower court that considered the health care in the d.c. circuit, conservative judges grilled the government's lawyers. and ultimately those conservative judges were in the majority upholding the health care law. there was a voting rights act case a couple years ago, where they grilled the government lawyer and ultimately upheld the law 8-1. that said, you cannot sugar coat this for the government. this is a really tough day for the government. even the justices who seemed gettable, who because of their past writings seemed more open to an expansive view of federal power, seemed
