harris: it often is. it is a sad reality homophobic slurs are often directed at heterosexual or homosexual people. >> that is ok, under your theory. mr. harris: it is absolutely not if that person can show discrimination because of sex. what the courts cannot do is what the second circuit did -- the opinion is instructive and tells juries if they find sexual discrimination, they have found sex discrimination. i don't disagree that will be difficult cases at the margins, but the answer is not to change the ultimate inquiry and replace it with something congress could never have intended. >> if you have a minute, let me ask you this. let's imagine the decision-maker in a particular case is behind a veil of ignorance, and a subordinate who has reviewed candidates for a position says, i will tell you two things about this candidate. this is the very best candidate for the job, and this candidate is attracted to members of the same sex. and the employer says, i'm not going to hire this person for that reason.

harris funeral homes versus the equal opportunity commission. mr. cole? >> mr. chief justice, and may please the court, aimee stephens is a transgender woman. she was a valued employee of harris funeral homes for six years until she told her boss she was going to live and identify as a woman. when harris homes responded by firing her, it discriminated against her because of her sex for three reasons. first, firing her for failing to conform to explicitly stated stereotypes about how men and women should behave. it discriminated against her in the same way as price waterhouse discriminated against anne hopkins for failing to walk and talk more feminine. it cannot be that anne hopkins would lose her case on the same facts. second, harris fired her for identifying as a woman only because she was assigned male sex at birth. in doing so, they fired her for contravening a sex specific expectation that applies only to people assigned male sex at birth. namely, that they live and identify as a man for their entire lives. that is disparate treatment on the basis of sex.

the booker-harris bill provides real accountability and real transparency. but sadly, i think disturbingly the fact that the majority leader will not even allow the senate to debate the booker-harris bill reveals he's interested in neither. now, for a moment last week it appeared some republicans were serious about finding bipartisan compromise during a judiciary committee hearing on policing reform chairman graham said he'd like the committee to work together to find solutions. to sit down and see if we can reconcile the policing reform packages and come up with something in common. a number of my republican colleagues on the judiciary committee even expressed an openness to reevaluate in qualified immunity to ensure that there's a sense of accountability within police departments. i agree that these are difficult issues. certainly based on my experience under both republican and democrat majorities, i know the judiciary committee is capable of handling these difficult issues. i know because we've done it before in tough issues. let me give you an example.
