art roderick and harry houck are joining me. harry, this is very much ongoing. >> right. >> they are now hunting for one, possibly two additional shooters. the car that one was in is completely shot up. so art, do you believe these other people were in the car and were able to run? is that even conceivable? >> well, the officer who first encountered them and had a shootout and was injured, he knows how many people he saw. it doesn't look like he has a life-threatening injury. he's probably already relayed to the police how many were in that vehicle. that's probably why they are searching that whole area because i don't know how long it took for police to get there or if there was a direct scene or how close the officer encountered them to where the vehicle finally stopped and one man is dead. >> yes. >> the fact is, they know that there were probably three in the vehicle as a result of that encounter with that officer. the other two may be on foot. >> bobby, we can see from our aerial footage that you're looking at right now that

let's go to retired nypd detective harry houck and jonathan giliam, former navy s.e.a.l. and former fbi agent to talk about this horrific event. jonathan, if i could start with you. take us through what the law enforcement response to a situation like this is where the scene is still active. you heard the head of the inland regional center saying as far as she knows there is still potentially, potentially an active shooter on the grounds of this three-building facility. >> well, this is a very tense time for law enforcement when they rush into this because even though they get a phone call saying there's three shooters, there may be one. as you mentioned we've seen in the past with the washington navy yards. so they have to be aggressive but careful in who they engage as they move into these types of situation because you could end up killing somebody. as the department moves in, it's a quick reaction and then it slows down a bit as they systemically go through these different buildings. and they start to quickly if they can pull video tape, that typically is something th

let's bring in cnn nan list phil mudd, harry houck, as well as paul cruickshank. as jim said, this is something officials here and abroad -- especially here, have feared for a very long time would happen, an isis-inspired attack. now we have 14 people killed in what looks to be a possibly isis-inspired attack. >> that's right. this story is changing quickly. we transitioned this morning from speculation into what might have been the motivation for this attack. you have to have some sort of political motivation to consider an attack of terrorism. we didn't have that until this story started breaking, not only the direct connection for a pledge of support for al baghdadi. the timing is significant, if you're posting that during an event, you're indicating that was at least some of your motivation for conducteding the event. early on you're saying, how can that be linked to isis? somehow, some way, clearly it does. this changes the game for me. >> just to go to the investigation angel, again, this was prapd gleaned from looking at the cell phones that were crushed. w

commentator and former obama adviser, van jones, cnn law enforcement analyst and former nypd detective, harry houck analyst, danny cevallos. what are the moves for the prosecutors moving forward on this pretrial? >> first of all, you have a bunch of witnesses who have testified, and all of those transcripts can be used later on, they can be mined for prior inconsistent statements. secondarily, the prosecutor has shown its hand. now the defense knows what they're going to do if there is a second trial. and then you have to ask the question, well, how will this mistrial seep into the minds of potential jurors going forward? so that can you impanel a new jury that is completely free of any sort of bias or opinion about this case and able to render a verdict. >> when this happens, do prosecutors interview the jurors to find out what worked and what didn't work? >> they should, in this case especially. because they'll want to know, consider this. this is a mistrial because the jury was deadlocked. so that means, from the highest charge on down to the lowest charge, they couldn't agree. what that may mea

now, two former federal prosecutors, jeffrey toobin and sunny hostin, and former nypd detective, harry houckwere you surprised by this, sunny? >> i wasn't surprised by this, actually. >> you said they had rushed the charges? >> i've been critical of the decision that the state's attorney made, only because we know that freddie gray was arrested on april 12th. he died on april 19th in the hospital. she announced her charges on may 1st, anderson. i have never, in my career, seen murder charges brought against six different defendants in under two weeks. you just simply cannot investigate and put a theory together for a trial that quickly. and so, i'm not surprised that this jury struggled with this case. and i think that we need to call it what it is. this really is a loss for the prosecution. prosecutors win about 95% of their cases. there's a 95% conviction rate. only 5% of cases end up in a hung jury. so this is a really big problem for the prosecution, especially because they say they needed porter's testimony for the next two trials. one is january 4th, which is the van driver, officer go
