when the jobs act went over to the senate, harry reid decided to skip it going through regular order, through the committee, just have it going to the floor and allowed only one amendment on the jobs act. that was the crowdfunding amendment. and an amendment was substituted i in which is highly sub scripttive and doesn't give us very much flexibility at all in terms of allowing for a framework that works. so that was proving challenging. the reason why i dissented was not only because it was prescriptive, but then the majority of the commission at the time decided to make it even more difficult. so there was a question there in terms of ambiguity, in terms of the limits of investing. there was a net worth test and income test. it was am big in the provision as to -- ambiguous in the provision as to whether somebody could meet one of those tests or both of those tests. the question was if somebody was retired by but had a high net worth and didn't meet the income other test. the the majority of the commission decided to move forward with a test where you had to meet both of them. basic

well, these kind of tactics remind me of the former majority leader harry reid whose political schemes caused his party a 60-vote filibuster-proof majority. i know the distinguished senator from new york, my friend, the democratic leader, remembers that when members of his own party can't bring back home any record of accomplishment for what they've done during their time here in washington, it's pretty hard to make the case you should be reelected. and after harry reid blocked participation not just from the minority but also from the majority so that they couldn't go back home and demonstrate that they had fought and accomplished things for their constituents, their party suffered a very tough political price. so i would urge our colleagues to end this perpetual obstruction on nominations and legislations and everything else. noncontroversial nominees should not require days to get confirmed or judges for that matter, require a 30-hour postcloture vote in order to get confirmed by more than 90 votes. that indicates it's not a controversial vote so why burn up the time except out of s

changes but you have to get democrats over to your side as well, going back to the old order that harry reided. is it conceivable, when i hear chuck schumer and other democrats talking, doesn't sound like any of them break ranks, what do you think? >> we'll find out. we're trying to get the process started and it is a process, not going to be one bill. we're trying to advance legislation to get this going and that ultimately to get everything done that we want to get done in terms of health care reform, it's going to take more than one bill, and it is going to take bipartisanship because of the requirement to get 60 votes in the senate. david: senator, when you see john mccain, and again, he made a heroic effort to get here to vote for this passage of at least the start of some changes with obamacare. when he says we should go back to regular order, haven't we gone too far to do that? >> well, no, what i'm saying is we're trying to get the process started now, get this addressed. the problems with obamacare, but there is only so many things we can do under budget reconciliation, we've known
