in the end, why was major hasan -- why was major hasan -- the information about him from his colleagues at walter reed -- excuse me, in the wake of the review, the information and the evaluation of the jttf, when they made that evaluation, did they interview major hasan? if they didn't believe him to be a threat, if they believed the communications to be legitimate, then why didn't you go and interview him? if you didn't want to interview him, why didn't you go and interview his colleagues at walter reed where the information that was not in the file might have been discovered? there are three typical responses to those questions. first, the protection of sources and methods. that they wouldn't want to have revealed where they've gotten those communications. i would suggest to the committee there's ways around that concern, to mask the source and method by which you did that collection. second, i worry about a sense of political correctness and i worry in a post-9/11 world because we very much respect and rely on the vast majority of law-abiding muslims and we've done tremendous cultura

they put higher ranking officers than major hasan in order that major hasan can't show signs of retribution that he would do anything to the members depending on how they vote. the panel members will be the ones voting. the difference is that you need a two-thirds vote in the military opposed to a unanimous vote on the civilian side of things. >> is it the death penalty? >> it will be the death penalty. that will be on the table. it will be two phase. panel voting on guilt or innocence which is a two-thirds vote and then you have the penalty phase which will be a vote as to whether or not they will invoke the death penalty. at that point you need a unanimous vote. >> if the defense is that he snapped under pressure, is a military panel, uniformed mill military officers more likely to accept that? >> i would say no. you are dealing with upper crust here. you're dealing with a major being tried. nothing under a lieutenant colonel will be on the panel. that being the case, it's the equivalent of having a bunch of harvard grads or college professors up there on the jury as opposed to a cross se

don, we reached out to hasan's attorney. he's asked investigators not to question hasan and doesn't know if he's been medically cleared to talk. as an investigator, don, how do you handle this? he's awake and they're saying he's talking. do you come right at it and say, why did you do this? how do you handle it? >> you know, mike, in the course of an investigation, they're not that many times that you go right to the person who is the accused, and you start to get information. investigators have got to go in all directions from fort hood and try and figure out who they should be talking to and try to develop that information that way. in fact, a lot of times it's much better to go outside and get the information so that you as the investigator, you have the knowledge, and therefore, if you do get a chance, if the suspect does talk, then you know when they're lying to you, or when they're telling you something that's just unbelievable. >> okay. since it began, the question is why. we're finding out here that he might have unv

in this case major hasan has been charged with counts. and what happens from there, those initial charges, the preferal of charges -- in a civilian world there's a grand jury proceeding which is closed, secret and private and only the prosecutor takes part in it. in the military, it's very much a -- it's a more open hearing, and as gene pointed out, the press would be allowed to go to it and it's a public hearing. at that point basically there's a mini-administrative hearing where evidence is presented by the government and the defense to make a recommendation to that commanding general are whether or not a criminal trial should go forward. so after that article 32 hearing takes place, a recommendation will go to the commanding general of what he should do with that case. and what i would point out here is along this step, what you can probably expect to see as a point of interest from the media, i would expect at some point here somebody will raise the issue of the sanity of major hasan. so there is a process in the military, under rule
