it hayes sunday morning. the car had been pulled over for speeding. the officer, who had a civilian in his car, tried to get the honda driver to get out. according to the police, the driver lunged the car at the officer, who fired at least ten times at the honda as it sped off. the officer had no choice. >> he drove at them. shots fired in the sense of -- fired at the direction of the driver. reporter: orange circles marked with the officer's spent shelz fell to the street. five shots hit the passenger side of the car two just missed the driver. he was arrested. the passenger was pronounced dead shortly after the crash. it's not known whether he died from gunshots, the crash, or a combination of both. now back here live. the driver has been identified as 23-year-old arthur pacman of oakley. charged with assault with a deadly weapon because of trying to run into that hayward police officer, and also homicide because the passenger in his car died as a result of his actions. the passenger has not been identified. we're live in hayward, abc7 news. >> ama:
