nbc bay area's kris sanchez joins us live from hayward with more. kris, do investigators and family members believe he's telling the truth? >> reporter: you know, i talked to michaela garecht's mother this afternoon. she steadfastly refuses to believe her daughter is not alive anymore. as for the death row inmate's claim, she says it's not the first time she's heard someone make a claim about her daughter that in her heart she doesn't believe is true. michaela garecht was 9 years old when snatched from this hayward parking lot 23 years ago. her friend saw the whole thing happen. this is the sketch police came up with using her description. wesley shermanine, a serial killer on san quentin's death row says a man in the picture looks a lot like his childhood friend loren herzog. the duo, herzog's confession was found allegedly coerced. shermantine senset a five page letter to a newspaper claiming where to find the remains of the victims. he said to look at the resemblance between his friends and the sketch of 9-year-old michaela garecht's kidnapper an

ktvu lorraine blanco joins us live from hayward. you were the first on the scene this morning and you have learned important information from police and neighbors. >> reporter: yes, we were first on scene at 5:00 a.m. this morning. scene as you can see police are still here right now. they are waiting for a search warrant to go inside this home. now some neighbors out here tell us they are not surprised by this violence. a massive police presence peppered a neighborhood. they are trying to figure out what lead to a man gunned down in a driveway. >> i heard a group of several shots. >> reporter: it's a neighborhood where families know each other well. >> my kids come out here and play we as neighbors we sometimes come out here and barbecue. i'm very concerned. >> reporter: but lynn tells us they have had problems at the home where the body was home. >> it was vacant. they had a lot of homeless people. i have kids. i can't afford to move. >> reporter: they are hoping to get a description of the suspect and a better idea of his vehicle

hayward police are asking -- and i'm kristen sze. hayward police are asking for the public's help.wanted for beating up an ex-girlfriend stabbed himself in front of officers. amy hollyfield is live with the latest. >> reporter: while i tell you what happened let me put up a picture of this man. police need help finding him. he's 32-year-old jose hernandez. police say he went to his ex-girlfriend's home saturday night and broke her window. police were called, they found him, they had him, confronted him, he pulled a knife and cut his own throat, stabbed himself in the chest so police detained him. they decided to take him to the hospital first that's when things went wrong. he was at the psychiatric pavillion in san leandro for evaluation. he was supposed to be released to police. instead, he was let go. that was sunday night. they believe he took a cab at the hayward union city border. they've looked at his old homes, residences they have not been able to find him. saw his picture 5'8 man, here's something that should make him stand out, police say he should have his bandages and s

live in hayward where he's been quizzing police about this new lead in a cold case. >> reporter: hayward police here are eager to talk with that death row inmate to find out what he knows about the disappearance of mckayla garrett 23 years ago. on november 19th november 19th 19889-year-old mckayla garrett was kidnapped from this grocery store parking lot. this call came from the store. >> see the white female. >> now there's a possible new lead coming from death row at sanguine ton, killer is saying he believes his former partner in crime lauren herzog may have been responsible. >> and that he had family which put him in close proximity to hayward. and here is a booking photo of herzog. >> there are similaritities there without a doubt that we had leads too with there were similaritities back in the day looked a lot like that. >> once talked with sherman since he killed himself last month. they have to wait because king county investigators are talking to him about more than a dozen other murders. i talked by phone to two bounty hunters one who said he talked with herzog the he died. >>

the carpenter from hayward. the 39-year-old was killed last month in a construction accident in milpitas. he was buried in a 12-foot-deep tren thatch collapsed as he worked in it. public service is at 11 a.m. this morning at the catholic church on patrick avenue and that's in hayward. >>> city of walnut creek is cracking down on a popular bar to reduce crime. the city council voted to limit the best hours of the lift lounge and grill. the bar will now have to close no later than 11:0 at night. that's an hour earlier than the existing closing time. it will close no later than 11:30 at night. >> if it's cut back to hours of operation to 11:30 my client believes they will have a tough time maintaining their business. >> walnut creek police say since lift opened in november 2009 they have received 80 calls connected with the bar most involving drunken people causing disturbances while leaving but police say other calls involve driving under the influence, physical fights and one sexual assault that allegedly happene

this morning we could be closer to knowing what happened to a hayward child who disappeared over two decades ago. a death row murderer says he knows what happened to michaela garecht. christie smith joins us with the latest. >> reporter: good morning. michaela garecht's mom is hopeful that her daughter is out there and might come home safe and sound one day. so this news is not comforting at all that a convicted killer on death row, wrote a letter to a newspaper claiming that his partner in crime, loren herzog, may be responsible for kidnapping michaela garecht in 1988. herzog recently committed suicide. wesley shermantine said he would lead investigators to a number of bodies in san joaquin county and he said also that he believed that herzog looked like the suspect sketch in michaela's case. her mom said over the years that many people have come forward with big claims. >> right. this is not the first time that we had somebody in jail say they knew where she was buried for that matter. we had somebody else a few years ago in indiana who said he knew where she was buried. >> reporte

developing news out of hayward.h is on for a suspect who was an advertently released from the hospital. authorities say he slashed his throat and police believe he is dangerous. gil diaz reports. >> reporter: hayward police believe he is not only a danger to himself but to the public. police wouldn't be looking for him this morning if he hadn't been accidentally released from a psychiatric clinic. jose hernandez is 5'8", 150 pounds with short black hair and brown eyes. he has bandages around his neck. he was taken to john george psychiatric pavilion in san leandro over the weekend for evaluation. he tried to kill himself by slashing his throat an stabbing himself in front of police. he was stalking his ex- girlfriend and confronted by police at her residence. he was taken to the hospital for his injuries then transferred to the psychiatric clinic for evaluation and was supposed to be returned to police custody but the clinic accidentally released him. he was last seen taking a cab at whipple road and medallion avenu
