i'm heather holmes and welcome to bay area news at 7:00. we're following breaking news where a man has been found shot to death. berkeley police said they were called to shots fired near russell street. they found a man in his 30s slumped over the wheel of his car. the paramedicics announced him dead at the screen, and his identity has not been released and no word on any suspects. this is the third homicide in berkeley this year. >>> well a big victory tonight for state workers. a judge has ruled against governor schwarzenegger in his effort to reduce the pay of 200,000 employees so minimum wage until a new budget is in place. the judge denied his request that would have mandated a minimum wage effective immediately. it means all state workers will receive all full wages until august, but left the door opened by ordering a full hearing to allow the case to proceed. kristen is live with reaction and a look at what's next -- christian. >> they are among the state workers that say they're very relieved that they'll be making their full payche

hello i'm heather holmes welcome to bay area news at 7:00. we begin with a fatal dogattack in the east bay. a man is under arrest tonight after his step grandson was mauled to death by his pit bulls. the attack happened before 9:00 a.m. on the house of the 1700 block of trail creek court in concord. 2-year-old jackob bisby and his four kwrogt brother were staying with adult relatives at the home. animal control says the 2-year- old wondered in the garage where three of five pit bulls were kept. 52-year-old steven hiachi has been charged with fellly child en -- >> the doings have been euthanized and will be tested for rabie >> he is held on $120,000 bail. animal control says it had no prior complaints about the dogs but neighbors say at least one of the pit bulls seemed aggressive. >>> well, san francisco there is an ordinance that man dates all pit bulls be spayed or nutterred. it was adopted after a fatal mauling there in 2005. did it make a difference? we are live in the city with more. >> reporter: heather, we learned this evening four out

>> reporter: well, heather we're way up here in the foothills in alameda county. if you call this road near mines road. you will see a portion of the hills known as rocky ridge, the general area where the incident took place. now, to give you a view from newschopper2, you can see this is a very dense rugged portion of the foothills. the santa clara county sheriff's marijuana eradication team came up here this morning along with deputies from alameda county. they suspected a marijuana operation. they came upon someone from the patch who they believe was armed. although the investigators are not releasing any details. deputies report shooting and killing the suspect. >> it's gonna take a a little while for our -- take a little while for our personal to be able to hike in there, number one, and not to mention all of the equipment, so this can collect the evidence and claim the body. >> reporter: there are no reports of injuries or suspects. a command post has been set up on this turnout off the road. the rugged terrain in and around the marijuana patch will continue

it's the weekend heather, the weather is cooperating. it's not as warm today as it was yesterday. but it's still quite warm inland, mid-90s. i gave you the wrong number earlier, i had a high of 99, that was only 95. you can see it right there it's trying to make a play for the inland valleys. that's where the fog is now, as it progresses into the midnight hour, i think we're going to get fog all the way over into the lafayette area, down to walnut creek. that's going to start further cooling. as you get a bigger fog footprint. you see stenson, something interesting, as you see how faces, that's kind of a south face. prevailing winds are north winds. as that northwest wind, you see how there's that clear holder. that's why storms in salinas tend to clear earlier. the other bay that's like that is santa cruz. you see a great example of that right there. look how that northwest wind is sheering the fog off the coast. i just know that after years of watching the coast and driving the coast. and those two places that face south tend to have nicer weather. these are the highs from today

. >> as you mentioned frank and heather, that started the situation.ut now we have a cool weather pattern and you just heard 50% containment at one of the fires out there, one of the big ones. it's just not as high a fire danger as you might expect this time of year. especially around the bay proper where temperatures are below the average. one thing we haven't seen right now that we've seen in the last few day, clearing at the beaches. the phone calls i've been getting from stinson bay, i get a lot of correspondence from my friends at the beach and they say they have just never seen it this clear. clearing in the forecast for tomorrow in the concord area and it's going to be just a little bit warmer than it was today. could get close to 80 degrees tomorrow. that's concord's forecast for tomorrow, 69 at lunchtime. a nice day, the average temperature for concord in late july -- no, we expect upper 80s. we will warm up gradually after tomorrow. where we will start to see a couple more 90s popping up but not widespread. there will be fog back at the coast

. >> reporter: heather, the shooting happened here outside the offices of lake merritt dental on webster street. the surveillance video shows two people walking up the sidewalk here toward the scene of the crime minutes before it happened. police today called the death of jinghong kang senseless and ridiculous, particularly since the motive appears to be robbery and the thieves killed the man for a mere $17. two people are clearly seen walking on webster. police say no one else was captured on the tape. they also tell us the clothing matches the description they've received from the witness. sergeant mike gant says he's elated because this surveillance video could be key. >> it helps tremendously. it's a casebreaker. >> reporter: gant says similar video has helped him solve two other homicide cases. the surveillance tape has also clarified that the suspects are a man and a woman, not two men as police originally thought. they describe the pair as black between 18 and 25 years old. the man is 5'8" to 5'10" between 160 and 170 pounds. the woman is shorter between 5'3" and 5'4ed" between 14
