director henderson. members of the public. members of the department. i'm assistant chief david lazar, chief of operations. this evening i'm going to talk about expenditures related to organized retail theft prevention. grant specifically about automated license plate reader cameras. okay so i have a brief presentation and then i look forward to answering any questions you may have. so what are alpr cameras? they are cameras that read license plates and vehicle descriptors. for example, the make and the model and the color of a vehicle while they're installed at high traffic intersections to detect stolen or wanted vehicles. our cameras funded well through our bsc organized retail theft grant. and you may remember, we received thankfully, $15.3 million to our department for organized retail theft. part of that will be to fund 400 cameras. all throughout the city. and that's a three year grant, which includes installation, maintenance and repair and operation and data storage. so we're thankful for the go

executive director henderson, thank you. uh, good evening. uh, we are currently at 82 cases have been opened, so far this year. uh, i there's a tick up, uh, this time last year, we were at 79 cases had been opened. so cases are continuing to come in. uh, and the case loads are increased. uh, so far this year, we've closed 86 cases. um, and on the, on the docket for epa, we have 308 cases that are pending. again that's a larger number than we had, uh, this time last year by, uh, over 50 cases. we've sustained nine cases, and we've mediated, uh, one case this year. uh, we have 33 cases whose investigations have have gone beyond nine months. uh, of those 33 cases, 19 of the cases are cold cases. there are ten cases that are pending with the commission and 96 cases that are pending with the chief. the chief's office, uh, in terms of this, this past week, uh, we received, uh, 15 new cases, uh, the largest percentage of the allegations for those cases were for neglect of duty, uh, from allegations that an officer failed to take required actions fro

so they say, and i'm sorry, director henderson. yes. so i'm just curious about what type of data that you have that shows the types of infractions or fines that are depending on the area, because really, what i'm, um, wondering about is we have, uh, more dense core. and then obviously these residential neighborhoods. and so i'm curious about whether whether you have the same types of fines and then depending on, uh, you know, in certain areas and then depending on the price of them, we might be, um, like a tier unfairly impacting certain areas because by virtue of the type of location it is, you know what i see? yeah. currently we can pull data for the types of, uh, uh, infractions that are, that are issued, but currently we don't have like a, a different pricing structure. we're in down in the cbd. it might be one price where, you know, maybe out in the avenues, it might be a different price. we currently don't do that. it's one on one size fits all. and so let's let's take for example the daylighting thing. this is the thing that's be

executive director henderson. good evening. yes, sorry. my apologies, director henderson, please. thank you. all right. uh, so, so far this year, we've opened 64 cases at the department of police accountability, and we've closed 32 cases. uh, our current case load is 344 cases. we've sustained and seven cases so far this year. uh, we have 28 cases. whose investigation have, uh, gone, uh, beyond, uh, 270 day period. again, that is not the final, uh, jurisdictional time for these cases, but there are cases who have longer investigations. and of those 28 cases, 19 of those cases are told cases. uh, there are still currently ten cases that are pending with this commission. uh, and there are still currently 91 cases which are still pending with the chief. uh, in the past few weeks or in just in last week, uh, since we last met, dpa received uh, 33 cases. uh, the highest percentage of those cases were for allegation that's 13, uh, were for allegations regarding a neglect of duty. uh for allegations that an officer failed to take required action. um. that's 13% of the 48 allegations that

indeed, here, on page 2, you see judges henderson, who is a george h.w. bush nominee, judges childs and pan, both nominees of this president, president biden, are filing an opinion for the court per cureiam, unanimous with all three of them. in terms of the substance, you'll remember that at oral argument, but also in the brief, one of the arguments that trump's lawyers made was would it actually be okay to prosecute, for example, former president obama for war crimes and went through a litany of hypotheticals of things that other presidents had done that they asserted were sort of on the edge of lawfulness and legality and suggested that, of course, presidents are immune, otherwise those people, a, would have feared prosecution, and, b, might be been prosecuted themselves. you see an ample refutation where they say a number of presidents believed themselves to be immune. they also talk about former president clinton who agreed to a suspension of his law license and a $25,000 fine, in exchange for an agreement from the then independent counsel not to pros

but the henderson test said section 230 only applies where there's an proper content in the publication and anything that isn't about the improper content isn't driven by section 230. it's a radical restriction of what to 30 has been interpreted to mean by 20 some years now. so, during oral arguments, the counsel for google who is a supreme court litigator tinted that this test might actually go most of the way. my own take is that the supreme court is probably not going to up and section 230 and restrict and some commentators who follow the court of law more closely, maybe what really happened in this case is that some of the more conservative folks that really want to restrict 230, which is the land definition from 1964 that really what happened was some of the conservatives on the court said let's take this case as we can get into section 230 and do what senator cruz did making it more difficult to restrict this disinformation or content by people whose views might be fine with theirs. >> that is one opinion. the second half of the opinion they may have picked the wrong case because
