but henry lee is at the courthouse with more on what happened today. >> reporter: the suspect did not answer with a plea to the murder charge. the entire attack was caught on video aboard the b.a.r.t. train. a witness says the suspect attacked the victim with his knife, after trying to steal his shoes. jermaine brim hid behind a wall during his first court appearance. prosecutors charged brim with murder for a deadly fight on tuesday. new details are emerging about what happened. the entire incident was caught on surveillance video on the train. sources say, brim removed a shoe from a sleeping passenger and tried to grab the other shoe. williams tried to stop him, and they began to fight. that's when the suspect tried to rub the good samaritan of his shoes. after struggling for several minutes, the victim took out a knife from his pocket. brim overpowered him, and stabbed him in his neck with his own knife. he tried to wash off the blood from the attack before carjacking two cars. hours before, brim had attacked a paramedic for a psychiatric evaluation, but he walked away from the hos

in union city, henry lee, ktvu fox 2 news. and a 29-year-old man arrested last week in connection with the orinda mass shooting investigation appeared in court today. the man pleaded not guilty to being a felon, in possession of a firearm. and a felon in possession of ammunition. investigators have not said exactly how he is related to the shooting that left five people dead. another man was also arrested last week on charges to the shooting. their arrests came days after five other men were taken into custody on suspicion murder. four of those men were later released. the district attorney's office that prosecutors didn't think they had enough evidence to file charges. >>> at 6:00, a man on a crime spree in l.a. has been shot and killed by police. it all started about 11:30 this morning in hollywood. police say the man was armed with a machete when he armed an auto parts store. after the robbery, police say he carjacked someone at a restaurant. he didn't get far before people, police were called. the suspect tried to escape b

henry lee, ktvu fox news. >> an investigation into a rash of garage burglaries. they hope they can identify the person seemed on this video. they were targeted in the early morning hours of sunday and monday. the thieves used garage door openers that were left in the homeowners cars outside. they were encouraging people to remove keys and garage door openers from their cars. >> a police officer involved in two deadly shootings in less than two years is again on paid administrative leave and it is unclear why. police confirm the officer is on leave. they urge the solano county district attorney attorney to prosecute him. earlier this year, he and five other officers shot and killed a man who had a gun on his lap in the drive-through of a taco bell. he was also placed on leave after each of the shootings, but that is standard protocol. >> police in san francisco arrested one of their own under suspicion of driving under the influence. the officer found assault - - there were signs involving him and another driver. the officer was off duty at the time and was arrest

henry lee joins us now from orinda where the investigation will include a review of about why officersay earlier in the night. >> reporter: orinda police certainly have a lot on their plate. how the department handles those noise complaints before the student will be a part of the investigation. for now, the chief that the city is not at risk, even though the gunmen are still on the loose. it has been four days since the hollowing night massacre in orinda that left five people dead. many of the normally quiet city are still unsettled. >> when it comes to things like this, it is scary no matter how you look at it, especially knowing there is somebody still out there and they have not been able to catch them. >> reporter: orinda police have not made any arrest or discussed a motive for the mass shooting. on monday, police told this car from the home and we saw a crime scene technician analyzing offense apparently hit by a bullet. steve solomon says the investigation will take some time. >> there is a very complex investigation thatto hold the people who did this accountable. >> reporter:

henry lee, ktvu fox 2 news. >>> we have new information about a deadly officer involved shooting on a south bay freeway over the weekend. as maureen naylor reports police say the shooting happened after an intense struggle between the police and the suspect who was reaching for a loaded gun. >> reporter: police chief eddie garcia identified the suspect killed by san jose police as a 29-year-old man who served two stints in prison by being a felon in possession of a weapon and he was armed with a loaded nine millimeter handgun when he was shot and killed. >> i feel frustration as i address you today. another incident with a convicted felon in possession of a handgun was not previously held accountable. >> reporter: the shooting was saturday afternoon. police have been looking for the 29-year-old suspect since an incident in october when they say the same man backed into a patrol car and let police on a brief chase. saturday police pulled the suspect over as a passenger in this lexus suv and say the suspects father who was driving complied with officer's orders to get out of the car but
