is debby hines. she's former baltimore city prosecutor. debby, just to put this in context, officer porter was charged with indangerment, failing to call for a medic and for not buckling mr. gray into a police transport van. based on these charges and these allegations what do you make of the hung jury? >> well, you know, it was a very difficult case for the prosecution. it's always been a difficult case for the prosecution. the reason is that improving in this case they had to prove in action. and in most manslaughter cases you're proving an action that that someone did. in this case they had to prove that he failed to have his feet down and he failed to call the hospital and medic for mr. gray. that just made the matter an uphill battle for the prosecution. >> the failure to take certain actions as opposed to taking direct action that you could say led to his death. given that uphill climb as you described it, that does not change in a second effort to try mr. porter, what do you do with the decision to move forward with a second trial?

the two employees, 28-year-old nastasia hines of burling city and mondja djamba. according to the arrest warrant the kidnapping charge stems from when one of the women made the 19-year-old crouch under a desk for several hours hitting him with a belt and kicking him when he tried to move preventing him from leaving. according to police documents she admitted to the abuse. she stated she would use the belt to threaten children. she also stated she forced the student to stay under a desk and placed her body in front of him blocking his ability to exit. hines also told detectives she beat students with a belt admitting to slapping students as well. in response to the charges bancroft released a statement part of which reads we have a zero tolerance policy toward any action that would endanger or purposefully injure an individual served at bancroft. our primary concern is always for the well being and safety of those we serve. now a bancroft spokesperson says both of those employees have been fired. if you have any information about other cases of abuse you're asked t
