i want to bring in cnn legal analyst, paul callan, criminal defense attorney and former prosecutor hln defense attorney joey jackson. so quite a dramatic day. a lot of reaction on behalf of the defendant. and usually my first question to someone like robyn curnow is how did the jury react. and there's no jury to react at this point. there's a seasoned judge on the bench. does that have any effect, does it matter at all, that he had that reaction? >> you know, ashleigh, not to a judge. remember, the judge has been through so many experiences, and the purpose of a judge, really, is to separate the emotion and to examine the facts. and, you know, when it it comes down to a regular jury trial, and it's interesting, because that's the first thing you said, right, ashleigh? how would a jury react to this situation? but there's no jury there. and so you have to believe that the judge is evaluating the facts and the facts only and with regard to him vomiting or holding his ears so he doesn't have to hear it or putting his hands down into his face, it does not have the impact it would upon civi

chief legal affairs anchor dan abrams in the studio with us and nancy grace host of "nancy grace" of hlncase against pistorius? >> well, on the outside looking in the case seems very, very strong and i base that largely upon michele berger's testimony. she states that she heard loud screams then one gunshot then three quick gunshots. that would indicate that pistorius knew it was his girlfriend before he fired. now, her testimony is under attack and not only that, this is very important, she testified through a translator and the old adage lost in translation i think is going to be problems with that ear witness. >> dan, picking up on what nancy was saying there about the eyewitnesses or the ear witnesses and how powerful is what they're saying. >> they're crucial. if there was an argument followed by shots, that's devastating to pistorius' case because his position is there was no argument. maybe i was screaming because i was scared. but there was no one arguing so if you've got these ear witnesses who live nearby saying not just that they're hearing screaming but hearing an argument, t

, chief legal affairs anchor dan abrams and again from atlanta nancy grace host of "nancy grace" on hln. dan, i want to start with you, the question premeditation remains there as we just heard in matt's piece, no smoking gun yet. but do have these texts, a bombshell introduction, words like scared, attacked, and protection used in the texts that were read. what do you make then of the texts that were introduced? >> it's really important in backing up the earwitnesses so you have witnesses coming in and saying, i heard a fight. i heard a man, i heard a woman. there was a fight there. that is crucial for the prosecution's case because if they can demonstrate there was a fight, followed by the shooting, they probably have a murder case. now, what this does is it provides context. it says, wait a sec, this isn't out of left field. this isn't out of nowhere. these aren't people who had never had these sort of blowouts before. we don't know exactly the degree but the fact that she's talking about the fact that she was scared i think provides context and support for these earwitnesses' testim

. >> we're going to bring if dan abrams and nancy grace, host of "nancy grace" on hln joining us froming. >> good morning. >> we heard in matt's report about the former police officer and being grild about mishandling the evidence. how damaging is this? >> some of it really matters. some of it doesn't. meaning, i'm not as concerned about the allegations of, were certain pieces of evidence held in the locker versus somewhere else? that is less significant to me that evidence may have been moved before photographed. it will back up on undermine oscar pistorius' own account. the key to this case is oscar pistorius' story. what he says happened and how. part of the way you can determine is he telling the truth is based on where certain pieces of evidence were found. if it was moved before it was photographed, that is a big point for the defense. >> how do you feel about that, nancy? some people were taken aback when the former police officer said, yeah, we may have stolen a couple of his watches. big deal or not? >> it's a double-edged sword. dan is right in a sense that, if one of these

on the phone right now, hln law enforcement analyst mike brooks. mike, great to have you here with us. tell me, if you were investigating this, how concerned would you be about the stolen passports? >> i would be very concerned. and the fact, pamela and joe, that the two tickets that were bought from south china airlines were bought basically were issued together. when it comes to terrorism, i spent six years on the joint terrorism task force and worked a number of plane crashes and i don't believe in coincidences. what the fbi and other intelligence agencies, i guarantee right now going through that man fast and looking at each past and you have the passports in italian and austrian citizen who appear to have bought them together. those are at least two of the stolen passports we are talking about. i don't believe in coincidences and they're going to look at every single name on that manife manifest. >> what does it tell you, mike, basically the two people who use the stolen passports bought their tickets together, what exactly does that say to yo
