>> well, i think because they watch cnn, as well and know what is happening to this president. i think we have to sort of look at sort of the totality of what we have found out today which is essentially how much leverage the russians had over trump as a capped, over trump as a president. as aened ca, he clearly wanted the personnel dealings for his real estate to go through in russia. that meant that the russians had something on him. then he lies about it which means the russianss had something on him and they wanted changes in policy which trump was sort of obliged or willing to do. so the amount of leverage that the russians had over trump whether it was exposed or not is something that we didn't know before but now is sort of fully exposed by michael cohen. that's a very, very good place for the russians to be because it's destabilized not just the presidency but of course, our american democracy at this stage. this is a no laugh day today. this is pretty shocking. > bob baer, you say since 1986, russia has viewed trump as a man they could do business with and they play the long game. explain that. >> well, they could see right away that he was biddable. in 1985, he started taking russian money, mobster money from brighten beach. these people were connected to the kgb. he hosted a lot of these people. they're buying and selling apartments. and he also mimicked, parroted the soviet line in those days and he was perfect. the perfect dupe for the russians and so they hang this hotel over him in moscow. russians had no intention of letting him build a hotel in '87, i know that for a fact but they invite him there but it's actually the kgb and look at had guy as a replacement for armened hammer who was ailing at the time. they know trump very well. they had report after report after report and they knew that you even his running in the electioning in 2016 was a victory for them because he was -- he overlooked the invasion of crimea. they loved the guy and they could count on him because he needed money to do their bidding. he was biddable. they knew it. >> this news mueller dropped this news, juliette, the cohen news right before trump got on the maybe to head over to the go-20. this is a theme we have seen, russian news breaking as the president heads out on international trips. do you think there is something to be said about the timing here? we're looking at the levering and and blackmail and the real estate and. let's not forget the election side of it. this only, would for putin, all this blackmail and leverage if trump wins. and that is why these two pieces of the investigation, the election hacking, the fake news, it the whether there's meetings about wikileaks and the financial stuff are related because putin's lever and only, would if trump's in charge. that's why let's not forget the national security and election side of this, as well as we're following the money. >> is it possible, juliette said maybe it's just a coincidence. is it possible, bob, that mueller is trying to send a message to putin? >> yes. i was, if i had to bet last night whether he would have voted yes today or not, i probably would have said he wouldn't vote yes. he held the vote open for an hour because he was deliberating what to do. he voed to move forward the procedural vote but still frustrated. the reports were clear he was still very frustrated about what to do and that he was still unsure. he made it pretty clear he was unsure what he was going to do today just because he voted for the procedural vote doesn't mean a guaranteed yes today. he wasn't the only one that started to backoff support. lisa murkowski, marco rubio after seeing this memo issued from are the justice department back in 1991 about the jesse helms campaign and that racist attempt to suppress black votes back then, that began to show some cracks in the support for farr because they were troubled by how involved he was or was not in this. he claims he wasn't as involved. but it seemed to be he was more involved than he initially let on. that was not okay for tim scott or marco rubio or lisa murkowski. >> last night when van said that he was a standup guy, right? >> he is. >> you said it, too. i said van said, well, despite his vote yesterday which was a procedural vote, it wasn't the final, that he had done enough good things where he wouldn't hold one thing against him but look what happens today. it was good that he gave him credit for. >> he's done this. he beat back another nominationing that had racial overtones. >> alice, you defended thomas farr's actions saying he was not guilty of suppression. what's your reaction to this? >> i still defend him. at the same time i disagree with senator scott's decision, i respect him. i respect the fact that he took his time and he did his due diligence and he looked into this and he investigate it clearly and as tara said, he's done this before. he voted to proceed with a certain vote but the end of the day he voted against judicial nominee. >> what's the reaction from trump supporters on this? are they upset with tim scott? >> they're not happy with it because they wanted to see president trump's judicial nominees move forward. they support president trump because of his ability to transform the power of the courts. but look, this is one in many nominees we have out there. look, i still support judge farr. i think he was not as involved with the helms activities with regard to what many perceive as voteser suppression. he has said as much and i believe him. he has been very vocal with regard to voter i.d. election security which i think is important and defending congressional lines which is what he has done which i think is important. that being said, it is not unusual to see some people that don't agree with how he acted have issue with that. as senator scott, there are a lot of other people out there without lippingering issues that can be put forth. >> i know you want to jump in, tara. let me give some of the back story and talk more about him. this decision came after learning about farr's part in the use of postcards that intimidated african measures to keep them from voting in the 1990 campaign of senator jesse helms as you talked about. farr was a lawyer for helms campaign and scott said this in a statement. he said this week a department of justice memo written under president george h.w. bush was released that shed new lights on mr. farr's activities. this in turn created more concerns. weighing these important factors this afternoon, i concluded i could not support mr. farr's nomination. does that send a message to other republicans that some lines just cannot be crossed? >> i mean, i would hope so. i mean, we've seen a lot of lines crossed in the last couple of years in the trump era. i think that it's starting to culminate. if this nomination had happened in a vacuum and we didn't have what just happened in mississippi with this racist now the senator that just got elected in mississippi and president supporting her, if what didn't happen with the president and his attacks on black female judicialisournalis charless vi, good people on both sides, all of those things. if all of those things hadn't happened and then you had this thomas farr nomination, probably no one would have noticed. there might have been back and forth but it probably would have gone through. >> but under the circumstances now, do you think someone else because you said other people, their support was starting to waiver. do you think someone else would have stepped up if it wasn't for tim scott? -should it? when you bundle home and auto... run, alan! ...you get more than just savings. you get 'round-the-clock protection. >>> the labor secretary, alex acosta, was said to be on president trump's short list to become attorney general. not anymore. a source tells cnn he has been ruled out. and that's because apparently of an investigation of him when he was a u.s. attorney in florida. the herald is reporting an acosta gave a sweetheart deal to a wealthy man accused of sex crimes including sexually abusing underage girls. cnn's rene marsh has the story. >> he's supposed to be protecting these victims and he was protecting jeffrey epstein, a pedophile. >> reporter: according to an investigation by miami herald jeffrey epstein got a sweetheart deal thanks to president trump's labor secretary, alex acosta. the paper found that as a u.s. attorney in florida in 2007 acosta and another federal prosecutor struck a plea deal with epstein's legal team just as the fbi was investigating years of alleged sex crimes. the herald reports epstein's accusations include at least 36 underage victims, a stream of girls in and out of his sprawling palm beach mansion, and allegations he paid teens to recruit more young victims. michael is a private investigator for the legal team representing some of the victims. >> i read the indictment. there was multiple allegations of sex trafficking, trafficking girls across lines, using his airplane to traffic girls, witness intimidation and then all of a sudden it disappeared. >> reporter: according to the miami herald the agreement allowed the defense to dictate the terms, shutdown the fbi investigation into additional victims and accomplices, granted immunity to potential coconspirators and it was kept secret from the victims until it was approved. now victims have filed a civil suit calling the plea deal acco acosta arranged illegal. as for epstein he pleaded guilty to just two state prostitution charges and served 13 months in county jail. he registered as a sex offender and paid restitution to his victims. secretary acosta addressed the plea deal in his confirmation hearing last year. >> based on the evidence the professionals within a prosecutor's office that a plea that guarantees that someone's go to jail, that guarantees that someone register generally and that guarantees other outcomes is a good thing. >> for victims to be kept in the dark entirely in conjunction with an fbi probe being shutdown and a favorable plea according to reporting that says he's able to have work-release privileges and be able to leave his jail cell and not have publicity in a large extent of these cases, that's what's so shocking about this. >> reporter: the herald interviewed several victims including virginia roberts who was employed at president trump's mar-a-lago resort. >> it was everything down to how to be quiet, be subserveiant, give jeffrey what he wants. and, you know, before you know it i'm being lent out to politicians and to academics. >> reporter: well, it's too early to know whether the justice department's inspector general will investigate as wassermann-schultz has called for. but this incident raises questions about acosta's judgment, if he brokered a deal that's unethical, legal or not in the interest of victims. don? witch hunt. where have we heard that before? also last summer, whitaker tweeted his approval of an npr article suggesting that the public might never learn mueller's findings because the attorney general could simply decline to release his report, and he wrote this. he said, article is correct. it will be very difficult to ever see evidence discovered by mueller grand jury investigation. okay? whitaker also weighing in on allegations of mueller conflicts of interest. here's what he said to anderson. >> bob mueller does have ethical duties as an admitted lawyer to practice law, and so did jim comey. so there are other rules in addition to the doj rules and regulations. and if bob mueller had these conflicts which were described in the beginning of this segment, that could raise some situations that i hope he's analyzed before he accepted this position. >> okay. so he said that. he has repeatedly argued that president trump's firing of fbi director james comey was not obstruction of justice. this is what he said. it was a radio interview after comey testified before congress. >> there is no criminal obstruction of justice charge to be had here. there's just -- the evidence is weak. no reasonable prosecutor would bring a case on what we know right now, and, you know, because it all boils down to what was the president's intent. and we really don't have any evidence of what the president's intent was. >> so remember that infamous trump tower meeting, 2016, june of 2016? he weighed in on that, the one with don junior, jared kushner, and others. they met with a russian lawyer with ties to putin. >> i think, you know, sort of to suggest that there's a conspiracy here, i mean you would always take that meeting. >> it's also worth noting that whitaker has personal ties to one of the witnesses in the mueller investigation. he was the campaign chairman for sam clovis' 2014 bid for state treasurer in iowa. clovis has been interviewed by mueller's team, testified before the grand jury. and according to "the washington post," clovis was also lifted as an unnamed campaign supervisor in the indictment of former trump campaign aide george papadopoulos. so as we all know, the president has railed against mueller's investigation from the very beginning, calling it a hoax, a witch hunt 160 times since last spring. trump has even floated the idea of actually firing the special counsel. over a year ago, i asked whitaker whether the president would actually go through with that, and here's what he said. >> i don't. it will be a spectacular -- we will spend a lot of time talking about this if and when he does. but i think this president puts these things out there into the ether of politics to see what the commentators and the rest of the folks think and respond, and then ultimately makes his decisions, i think, based on that feedback. i don't think there's a single person that's heard this today that hasn't been, that's a little ill advised, i think, would be a proper term. >> hmm. it's also important to note that kellyanne conway also said today that trump won't fire mueller. who knows if she is right? what we do know is the man he appointed to oversee mueller's investigation has repeatedly criticized the investigation that he will now be overseeing. is this all just a slow-moving saturday night massacre? i want to discuss this now with mr. john dean, the former white house counsel to -- a former white house counsel. thank you so much. so good to have you on this evening and every single night. i got to ask you a question before we get starts, right? they were saying 2 was a resignation. he resigned. if your resignation reads, john, at your request, i am submitting my resignation, what does that mean? >> it's not unlike my resignation where the president requested it and accepted it, and i was the last to learn that he had done either. >> yeah, that means you're fired, right? >> that's exactly what it means. in fact, the press room actually put out the word that all of us had been fired. >> yeah. you say that trump's firing of jeff sessions seemed to be planned like a murder. explain that. >> well, as i watched him today at the press conference where he clearly dodged the question of something that was on his mind because it happens a couple hours later, and it has been very carefully plotted. and what also happened is whitaker just didn't appear out of nowhere. this is the scenario they had originally planned for rosenstein, to replace him, is to have whitaker become the deputy attorney general. that plan, after the president and the deputy attorney general started getting along, then got escalated today. and as i say, it was carefully planned, and whitaker was ready to step in. he had just the right credentials under the federal vacancy act. so they'd studied that. they obviously had gotten an opinion out of the white house counsel, and they knew exactly what they were doing, as i said earlier, which is planned like a murder. >> i want to read a quote from michael beschloss, the presidential historian. he says, if this is going the way it looks, this is ten times worse than nixon. is he right? >> i think he is. one of the things we know about nixon today is that he did collude with a foreign government to get his presidency. that happened during the '68 campaign. that was something that was buried and kept buried during the totality of his presidency and only a couple years ago did we learn that. what makes this bad is the degree with which the plotting and the actions are being undertaken. the scheming that's going on to try to undercut a very legitimate first of all counterintelligence investigation and then a related criminal investigation. >> mm-hmm. so do you see this as -- how do i say it -- a slow moving saturday night massacre? and if you can explain a little bit, saturday night massacre is referring to the nixon times. but go on. watergate. >> that was the firing of archibald cox, the special prosecutor who refused to stand down when nixon asked him to in appealing to a court to get a decision favorable to get the tapes from nixon. and when cox refused to stand down and held a press conference as to why, nixon called his attorney general and asked him to fire the special prosecutor. the attorney general, elliott richardson, who had pledged not to do that before the senate judiciary committee when he was confirmed, turned to his deputy attorney general, and he refused to do it. and the only person who those two men convinced to do it was the solicitor general, robert bork, who did execute the president's order. >> so is this a slow-moving one? >> this is -- this appears to be a slow-moving one. i don't know that trump will go so far as to remove mueller. you know, there are a number of members of the senate on the republican side who have said that's a step too far. mitt romney, who is now in the senate, said it during the campaign. lamar alexander has said it. not just those who are on their way out the door have said it. so it's very possible that trump knows he's playing high risk if he ever were to go that far. i think what the plan may be, as was said by matt whitaker, that you can do a slow death by cutting off his funding. >> yeah. >> cutting off his resources. cutting down his staff. and giving him some turndowns on his prosecutorial choice. >> squeeze the life out of the investigation. thank you, john dean. i appreciate it always. thank you so much. >> thanks, don. >>> can the new democratic majority in the house -- can they do anything to protect robert mueller? because there are a lot of people in the country, both democrats and republicans lo are concerned about what's happening here, that the law -- can that the law is not being followed in a sense. that's their concern. >> people are absolutely should be concerned. into what do you say to them. >> people absolutely should be concerned. donald trump fired jeff sessions for one reason because if you look at jeff sessions' policies they were in lock step with donald trump. they only disagreed on russian investigation. only reason he fired jeff sessions was to put in someone who would interfere with the special counsel's investigation. that looks like obstruction of justice, the same way firing james comey was obstruction of justice. >> then the congress, both chambers of congress, both chambers of congress, meaning the senate and congress, haven't had many checks on this president basically on this administration basically. he's able to with a blank check able to do whatever he wants to do. what do you say to the folks who say they're not going to do anything differently than they've been doing over the last couple of years? >> that's one reason democrats had a blue wave empty house of representatives last night. people wanted to put in a check and blaebs on the president of the united states and his administration. come january, the house of representatives is going to be a coequal branch of government. we're going to act like it and make sure we hold donald trump and his administration accountable. it's also important to understand with subpoena power, we can get relevant documents and subpoena relevant witnesses. we can continue nell investigation that donald trump tries to ash trar little stop. >> does that mean more investigations? does that mean reopening the congressional investigation into russia? >> that's a great question you asked. i was just on a conference call earlier today what we'll do. we'll meet next week as a caucus and meet with folks on the committee to prioritize the investigations we do do. but we're also going to look at ways of working with the president on moving america forward. we're happy to work with the president on issues like infrastructure, on covering pre-existing conditions, reducing health care costs. we can do both, have a positive agenda and also hold the president and his administration accountable. >> after all the animus over the past couple years especially democrats in calling people names, do you nil that this president is going to work with you? >> i think it's possible. in his press conference today he did talk about that quite a bit. he also understands power. the democrats now control the house of representatives. we are the power to stop stupid legislation. we can advance positive legislation. we also have subpoena power. there was a big incentive for the president to make deals with the democrats. >> do you think that was part of the reason for his mood today or maybe the main reason is because he realizes that now he -- he is going to having to answer to someone at least? >> the president clearly was in a sour mood today. if he thought the election results were good, are he would not have the announced the firing of jeff sessions today. he would have waited till next week. he really wanted to change the subject. we actually had a blue wave not just in the house of representatives. we also won a large number of legislator seats net increases in governorships. you saw a blue wave across much of america last night. i think trump wanted to change the subject. >> can i ask you because you have subpoena power. a big part of the equation here for a lot of folks that people are really concerned about is that this president has never released his tax returns. they don't know ho he's beholden to, who he's done business to, who he might, i'm not saying he does, owe favors to possibly. as part of the mission of this congress going to be to get the tax returns and make sure that this administration and this president abides by the emoluments clause? >> i think it's important to see the president's tax returns to make sure he's not under improper influence by foreign entities or organizations and the issue of subpoena power, there's an actual law and process that allows the chair of the house ways and means committee to get these tax returns. i do expect that to happen. >> when is all this going to start?
