holly hughes is here. this trial -- this is something else.ions really give you a peek into the minds of jurors. this doesn't happen in every state. >> right. there's only three states in the nation that allow jurors to submit questions. >> arizona's one of them. we've seen lots of high-profile trials. conrad murray, casey anthony. i don't know if we've ever gotten a peek into the jurors' minds like this. >> no. and this is invaluable for both sides because what you can do is -- you sort of get an idea where they're going, where their thought process -- are they buying the defense or are they really siding with the prosecution? and then you get to come back and sort of remold. the defense is still in their case in chief. so a lot of the questions, it seemed to me, were sort of poking at this self-defense thing. why didn't you call for help once you were safe and out of the situation? why didn't you do x, y, z? what the defense can do in response to that is have their experts who are coming up after her answer those type of questions. why would

holly hughes joins me, she's a criminal defense attorney.e is suing the city and police for defamation, civil rights violations, false arrest, does he have a case? >> he does. i tell you why. his friend calls him, says dude, you're on the news, wanted in a gang shooting. he thinks that's a mistake. googles himself, finds out they have put my name out there. he goes down to the police station a couple days later to say what's going on, let me turn myself in, i didn't do anything, but you have my name and photo out there. arrest him for another crime, you beat a man with a baseball bat. what are you talking about. they book him, hold him three days, never file charges and finally spring him. here's the thing. it was false arrest, took his fingerprints, booked him, mugshot is out there, they have that crazy website out there, they got your mugshot out there, then you have to pay to get it taken down, his life was turned upside down and he did nothing wrong. >> probably still on the internet. >> it is forever. lives forever. >> his lawsuit doesn

holly hughes is here. she is a criminal defense attorney. holly, i have to tell you.ime buying this argument that the prosecution may have been too aggressive and that that may have backfired. the way i see it, you're watching a woman who has had at least three stories. of if not more. about what happened that night. >> yes. >> i mean, isn't that enough? for the jury? >> well, it depends. because remember, the jury is made up of human beings, and they all come in with their experience. and juan martinez, prosecutor here, was fantastic when he honed in on actual crime. i think some of the folks who are saying he might have been a little rough were talking about other parts where he would nit-pick her on things that weren't really material. and it may have looked like bullying at that point. you want a prosecutor to home in on the murder. you weren't crying when you did this, weren't crying when you did that, when you stabbed him, slit his throat. we all expect that. but there were other times during this dance the two of them were doing this past week where he would --

we have, just seated, criminal defense attorney holly hughes with me.hologist, easy for me to say, paula bloom. welcome to all of you here. also cnn legal analyst sunny hostin in new york for me, federal -- former federal prosecutor. and in phoenix, arizona, cnn's miguel marquez. he has been inside this courtroom this afternoon. so, miguel, let me kick things off this hour with you. tell me where things stand right now. >> reporter: well, we are waiting for court to resume, which we expect will happen any minute. i'm monitoring it here. the lawyers for both sides and the judge and jodi arias went through the 100 or so questions this morning. both sides objecting to some. the judge ruling on some of those. six of the questions were -- will not be allowed. parts of other questions will. one thing to keep in mind, it is 100 questions, but many of these questions have two, three, four parts to them, it sounds like. we could be here for quite some time. they will be entering soon, we believe, and the jurors will come in and they will -- questioning will begi

criminal defense attorney holly hughes is here to talk back with us. ne young woman says she went to the school official and she was told this. i can't believe this when i heard this. rapists like football and if you look back in the game would you have done anything differently. >> right. that's not the first time we have heard those allegations. there is another young lady who has come forward and when she spoke out publicly, first they have to go through the honor corps, which is student-run at unc. and they said to her when she complained of rape, no, there was no rape. and they asked her questions and they said she -- they made me feel like i had done something wrong, like i was being questioned when i was there reporting rape. then they found no finding of rape. and when she went out on campus and said, you know, they're not taking sexual assaults here very seriously, they filed a complaint against her for disrupting campus life and making the life of the alleged rapist hard, even though she never named him. >> she thinks it's retaliation. >> she

maybe holly hughes as a defense attorney can explain it to me.nse attorney in the studio right now. she can't make sense of it. >> oh, yeah. >> can you? >> thanks, sunny, for putting me on the spot like that. appreciate it. but what he's going for here is, again, it is unusual, brooke, because this is not the typical battered woman defense we see raised. when we think of a battered woman, we think someone physically, repeatedly assaulted. now admittedly they're throwing in on or two accusations of domestic violence. he shoved her to the ground, what they are really trying to focus on is an emotional abuse and hope that rolled up with those two accusations or three accusations that he was physically violent with her, that will amount to her having a reasonable fear, because that's what the jury will have to do, they'll have to interpret what was in the mind of jodi arias at the time that she killed him and was it reasonable to think that this man was going to kill her if she didn't get to him first. >> talking about the jury's interpretation and w
