horowitz. i.g. horowitz: thank you mr. chairman, ranking member feinstein, members of the committee. thank you for inviting me to testify today. our 500 plus page report provides a thorough, comprehensive, and objective recitation to the facts related to the departments and fbi's handling of the clinton email investigation. it was the product of 17 months of investigative work by a dedicated oig team that reviewed 1.2 million documents and interviewed more than 100 witnesses many on multiple , occasions. the review team followed the evidence wherever it led, and through their evidence, we were able to identify inappropriate texts and messages discussed in the report. additionally the oig's , painstaking for an sick investigations discovered texts that would have been lost or undisclosed. as detailed in our report, we inappropriate political messages we uncovered cast a cloud over the midyear investigation, sowed doubts about the credibility of the fbi's handling of it, and impacting the reputat

we start with michael horowitz's opening statements. mr. horowitz: thank you mr. chairman, members of the committee, thank you for inviting me to testify today. page00 plus report provides a thorough and comprehensive and objective facts of the fbi handling of the clinton email in the station. it was the product of 17 months of the team that reviewed well over 1.2 million documents and interviewed more than 100 witnesses. many on multiple locations. the review team followed evidence and we identify the inappropriate messages discussed in the report. oig's painstaking forensic examinations uncovered thousands of text messages that otherwise would have been lost or undisclosed. as the guilt in the report, we found the inappropriate messages we uncovered cast a cloud over the investigation and brought doubt to the credibility of the fbi's handling of it and impacted the reputation of the fbi. we found the implication that senior fbi employees would be willing to take official action to impact the electoral prospect of a candidate, we found that deeply troubling and a

horowitz for your service. chairman gowdy and others have mentioned the very troubling e-mails that were very critical of president trump. so my question to you, none of these e-mails were made public during the election, correct? that's what i made they were not -- >> no, the text messages were not. >> they were not made public during the election. so therefore it's fair to say that these e-mails did not influence the election, correct? they weren't made public so they did not influence the election. >> i don't think these text messages at all were out there in 2016. we uncovered them in 2017. >> okay. they did not influence the election. now, the fbi conducted investigations related to both presidential candidates, but director comey publicly released information only about secretary clinton while he kept secret information about the investigation related to the trump campaign and the russian government, correct? >> he followed the rules open the trump -- the russia matter. he followed the rules on the clinto

horowitz.he i.t. worker that managed the clinton server lied to the fbi repeatedly. he denied deleting clinton e-mails, he denied that clinton's staff had ever asked him to delete the e-mails, he denied knowing the e-mails were under a preservation order. on march 2015, he had a call with clinton's lawyers. after that he deleted the clinton e-mails, invoked the fifth amendment to avoid questions about that call, even sent an e-mail saying that he was part of "hillary cover up operation" and he later claimed that that was only a joke. there was no search warrant or subpoena for the laptops used by the clinton lawyers to see what they knew about what he did. he did not get the mueller treatment. no charges for lying to the fbi repeatedly. no pressure to flip and testify against clinton lawyers. he got immunity, this is a good example of that double standard in these two investigations and why more and more people are starting to believe the mueller investigation lacks fairness. the report noted t

horowitz. thank you for your testimony. thank you for the work you've done. thank you for the investigation you've overseen here today and thank you for the report that you've made. i'm very struck by the report that you made. 500 pages. 17 months of investigative work. 1.2 million documents, including over 100,000 texts and instant mess yaeages and interviewed ov 100 witnesses, many on multiple occasions. am i correct that your findings as it relates to this clinton e-mail investigation is that the decisions that were made, the findings that were made, the investigations that were conducted were not negatively -- the outcomes were not negatively impacted by the biases of any individuals? >> correct. the decision -- our conclusion was that the decision of the prosecutors was not the result of political bias based on the evidence we reviewed. >> thank you. and i am very disturbed about the behavior of many people in the fbi, starting with mr. comey. i find his ego exceeded his ability to discern

horowitz. i'm not buying that the clinton e-mail investigation was on the up and up, and the reason i'm into the buying it is because the two people intimately involved, one, the guy -- the lead investigator clearly did not want to see donald trump become president of the united states. finally, do you agree with me that finding her liable criminally would be inconsistent with stopping donald trump? if they found hillary clinton was criminally liable, that paves the way for donald trump. can you put those two things together? >> i guess it would depend when. >> how about july? before the convention. >> it clearly could conceivably -- >> well, not clearly conceivably, that's exactly what's happening here, folks. you cannot hold her criminally liable and stop him. as to the law, why did they change gross negligence in the original >> i think i would defer to the inspector general to look into that. >> why did they do that? >> the explanation was that -- >> can i suggest something. >> yeah. >> gro

horowitz, the report says mr. comey's macinations said it would be -- is it the idea that lynch and yates were overstepping their authority? that it would look like political interference? what is that about? >> couple things. they were responding to the fact that director comey rather than speaking to them directly went through his chief of staff to one of their aides to them to relay his view on what he was going to do. when they told us their assessment at that point was based on their prior dealings with director comey was first of all the they went to him directly and said don't do it, it would look like strong arming and they weren't sure if he would supply or not with the instruction. they concluded that it would be more effective or they would have a better chance of changing the decision if they went back the same way to him with their message, which was to their principal associate ag to him. they reported back that they objected or recommended or -- clarify. they told him that they did not believe he sh

horowitz. should there be further investigations to what happened regarding the clinton investigation? >> as inspector general, that's most clearly not my decision to make. the last thing i'm going to do is step outside the authorities you've given me, the congress and the igf. >> so you can't respond to that? >> no. >> is there anything in this report that indicates that there should be another special counsel or further investigation of the clinton matter? >> well, senator, the decision about whether or not and when to appoint special counsel is reserved to the attorney general or the deputy attorney general if the attorney general is recused. one of the key take-aways is the fbi director shouldn't get out of his lane. >> so as deputy director rosenstein said to you that you should begin an invest combination into the clinton matter? >> i can't comment on my conversations with the deputy attorney general about investigations. >> thank you. >> here's where we are. i've been told that one repub

there's the question of comey, we heard from horowitz apparently he's being investigated now. former fbi director, that's something we didn't hear from rosenstein. >> that's right. there's no passion for this. they seem not to appreciate the significance of what has happened here and the impact it is having on public trust in the fbi. i mean, this is supposedly the nation's premiere law enforcement. the world's premiere law enforcement agency. it has been caught red-handed. in giving hillary clinton a pass. though, there are clearly arguments about that, but the people involved express their opinion, some of them, that we shouldn't go too hard on her, and the same people involved, some of them said we'll stop donald trump from becoming president. that is a very significant, i mean unique, unique to the history of the fbi and yet the director sits there as though it's just another day at the office. david: and despite its historic significance, so does the media itself with the exception of you and us and a few other media outlets. media is basically ignoring the story. that's

horowitz writes?nd was there a lot of the condemnation against hillary clinton and the use of her private server. >> the i.g. highlighted the potential bias in the handling of the wiener laptop issue. it took judicial watch to uncover the specifics of. arthel: what is the bias there? >> they waited a month perhaps because they were more eager to go after candidate trump in september and october of 2016 than to reopen and rehash the clinton email issue. arthel: does there seem to be much condemnation of that issue? is there a there there? >> the i.g. reports in my experience are cover-ups and expose's at the same time. there is a lot that's exposed. get accountability and that means putting a pause on the mueller investigation. arthel: the fbi director christopher wray said he'll be making changes in terms of sensitivity training and procedural changes at the fbi. i want to stick with the i.g. report. you just mentioned about the other five unnamed individuals who have been identified. including two ag

what do you think horowitz's report will expose this week? >> we are hearing it will be a 500-page report. it will be damning for the fbi and the justice department's oversight. the public announcements about the investigation. the decision not to prosecute announced by the fbi director, not the u.s. attorney's office. a very odd scenario. then the additional emails found on the other computer and the decision to announce that fact. so a very odd situation and a highly critical report is likely to come out of the i.g.'s office. eric: horowitz is known as a straight shooter. do you think he'll pull punches or get it out there? >> there has been a lot of criticism of horowitz from the president and there have been a lot of criticisms of the justice department generally. it's hard to know how this will play out in the media. but i think he'll give as straightforward a report as he can. eric: what else do you think will come out of the leaks? will there be specifics on not just leaks, but the way they handled the clinton administration. their vie

horowitz, the inspector general? >> well, we have a lot of questions for him.his report really was a bombshell, i think that's the right explanation and summary of it. it's over 500 pages. documents a lot of information and much of this we have been requesting through house judiciary committee and house oversight committees going back since last fall. we've just now seen some of the revelations and they are explosive. we have a lot of questions for the director to go through, the inspector general to go through and explain more of what they found, why they don't believe that this really did affect the outcome of the election and more people should probably lose their job at the fbi. jon: yeah, well, you seem to have some support in that from the attorney general jeff sessions before this report was released. he made a comment along those very lines, listen to this. >> if anyone else shows up in this report or have done something that requires termination, we will do so. jon: so the attorney general is threatening to job losses could come as a result of this rep

horowitz. may 17th, 2017, rod rosenstein writes a memo outlining the scope and parameters of the special council investigation. on august 2nd, 2017, he writes another memo that in some way alters, amentds, modifies the initial scope of the investigation. and yet we can't see that. the american people can't see that. it seems to me if you're altering the scope of an investigation into the guy that the american people made president of the united states, we, as americans, deserve to know exactly the parameters and scope of that investigation. so will you be able to get ahold of that august 2nd memo and make that available in the course of your investigation? >> gentleman time has expired but you may answer the question. >> i would have to think about how that connected to our investigation and what connectivity jermaineness it would have to ours. i'm happy to consider it. i've not seen either of those memos myself. like i said, on its face, i'm not sure the connection between that and the fisa. b

horowitz. they are testifying about the ig report that came out last week. let's listen. >> hillary cover-up operation, end of quote. he later claimed that that was only a joke. but there was no search warrant or subpoena for the laptops used by the clinton lawyers to see what they knew about what he did. he did not get the mueller treatment. no charges for lying to the fbi repeatedly. no pressure to flip and testify against clinton lawyers. quite the opposite. he got immunity. this is a good example of a double standard in these two investigations. and why more and more people are starting to believe the mueller investigation lacks fairness. the report noted that director comey pressured the team to close the case before the party convention. and he had already made up his mind to close it before all the work was done. question number one. isn't it improper to set a deadline to close a case based upon -- >> i think if that's the only basis for set egg the deadline, that would be a concern. tha
