nbc bay area's ian cull joins us now. ian, what are these social workers calling for? yeah, and they say that they need more social workers now to prevent future tragedies. the group works for the county department of family and children's services, or dfcs, and they specifically brought up that case of baby phoenix. she was a three month old girl found in a south bay apartment littered with opioids in may of 2023, and died of a fentanyl overdose, the county said. officers and social workers had responded to the home multiple times before her death, even removing two other children from the home. ultimately, the baby's father was charged with child neglect. the group says the county didn't include social workers in the decisions on whether or not to remove a child from their family, and though that has been resolved, they say they worry the current lack of staffing could lead to similar tragedies in the future. when social workers are working, 150 hours are assigned over their case standards, and crisises in our community are not being responded to in a timely manner.

ian cull today in the bay. well, out to san jose this morning. 509.ks like it's a lovely morning. wasn't too chilly when iumped in the car. cinthia pimentel is taking a look at the forecast. yeah, we're recovering those temperatures compared to starting with those frost advisories earlier this week. let's keep it in san jose and take a look at our day planner. after starting the morning in the 40s, we should go into the afternoon and actually reach about 64 degrees. so feeling a little bit more mild today as our routines get back in order. let's go up to the north bay. you'll notice a mostly cloudy skies through about lunchtime and just a little bit cooler there in the low 60s. in wine country we do have rain on the way already, making some returns up there towards the northern part of the state. it should push on through, giving us our first rain of the new year come 2025 tomorrow. but then the weekend looks good, so we have lots to talk about in my full forecast. i'll be back in just a few minutes. back to you. sounds good. we'll look forward to it.

nbc bay area's ian cull has been looking into the new laws and joins us now. okay, ian, what do they include? a lot of things, audrey. one of them creates new penalties for criminals who have those stolen items in return and intend to either sell or return them, even to the store. governor newsom signed ten of these bills at a home depot back in august and here in san jose, but they take effect today. and one says if you stolen over $950 worth of items, even if they're from different stores and in different counties, prosecutors can add those crimes up and charge you with grand theft. another allows stores to file a restraining order against you if you stolen from the and ban you from entering the business for two years. prop 36 passed by voters also went into effect two weeks ago. it allows for tougher penalties for property crimes along with fentanyl trafficking. it's important to get california back under control. we shouldn't have to go into stores and have the items we'd like to purchase in cases and have to get help, or they're simply not on the shelves b
