that's the alibi attorneys of the accused killer of the slayings of four university of idaho studentsg underway right now. bryan kohberger has plead not guilty to four counts of the first-degree murder in the november 13 slayings. the state has argued he must provide a lot more details about his whereabouts that night, but the defense is fighting that. jean casarez has been following the case for us very closely. >> reporter: well let me tell you, boris. the hearing has just started, and the defendant has a gray suit and tie, very formally dressed. he sat down very quickly next to his defense attorneys. now there is argument underway. and there are cameras in that courtroom. we are going to be able to see this hearing, every bit of it. but the judge's rule is not until the hearing is over will that video be distributed, so we'll have it as soon as it is culminated. one of the big issue is this trial, this death penalty trial, is suppose to start in about a month and a half. why? because the defendant has exercised his right to a speedy trial, which means that it has to be held within

cnn's veronica miracle has more. >> it appears university of idaho murder suspect bryan kohberger willix weeks, during a pretrial hearing where several decisions were made on several motions, the judge slated jury selection for one week for the trial set to start in october, saying he expects to bring in potentially a thousand potential jurors and that may not be enough. one of the key issues discussed during that pretrial hearing was kohberger's alibi. his defense team has said he likes to take long drives in the middle of the night and that's exactly what he was doing the night of the murders. now the state is saying the defense has taken too long to submit a witness list of people who may have seen him driving that night, and that there's not enough time for the state to prepare for cross-examination before the trial. the judge ruled that bryan kohberger has until the beginning of september to submit witnesses for an alibi if he has any. there were also other procedural items brought up, the defense wants more information from prosecutors about how they came to the conclusion that k

i want to tell you what's happening now in the courtroom because in idaho there are witnesses for thehing we know, the most important evidence in this case for it's that dna was found on the knife, in the bedroom, partially on the body of maddy mogan. it was unknown, but when compared to the swab of the defendant it was according to legal filings a statistical match. the defense wants to rip apart that filing. they want to look at every data and the prosecution doesn't want to give them every bit of data saying it's work product. that's what they're looking at now with witness testimony. in regard to alibi, the defense filed a notice he will give an alibi, that he was not in that home at the time the murders were committed. well, under the law in idaho he's got to show exactly where he was and exactly what people he was with identifying information. he says i was just driving around, i don't know where i exactly was, i don't have that for you, and i don't have any witnesses to give you names on. and that's going to be looked at harshly because without that definitive information for p
