i was very disappointed in justice the iliad to vote. relied on the necessary and proper clause. he said in that case because the reaching of my client's marijuana that was being grown by caregivers privately and not commercially, because it was essentials to the broader prohibition of interstate marijuana that they reach the non economic activity, therefore it was constitutional, what justice scalia held was it was ok to reach my client's marijuana because it was the essential to broader regulation of interstate commerce which was prohibition of interstate marijuana. i could say more about what that means but i am out of time. let me say one thing about that opinion. justice scalia's opinion which was about the necessary and proper clause was only about word necessary in the necessary and proper clause. the issue was whether it essential to a broader regulatory scheme would be interpreted in the same deferential way as the word necessary has been interpreted by the supreme court meaning congress has discretion when it chooses meaning among various meanings that might be convenie
