this is a regular meeting of the building inspection commission. i would like to remind everyone to turn off all electronic devices. first item on the agenda is a roll call. commissioner romero is excused. item two, president's announcements. >> i do not have any announcements. >> item 3 is directors' report. item three a, update on dbi's finances. >> i'm pleased to let you know that after four months of revenues and expenditures, we are looking at possible surpluses of about $2.4 million. this is on the revenue side. we are currently tracking over 15% increase year over year from last year. we are starting to see an improvement. it is a lot of a large projects that we are seeing. we still want to be cautious. we are projecting that the refunds that we continually get -- we get somewhere in the neighborhood of 20 to 25 refunds' every month that we have to process. they're still very small amounts, but we are keeping the $700,000, which is similar to what we had last year, as the projection. in terms of expenditures, we are 2% over what we were last

advisory committee would look at it and it would eventually come before the buildi building inspection commission. the department or commission also has the opportunity to initiate legislation themselves. so that is sort of an alternate rou route. the commission would obviously, if they were to do that, they would have to put something on their agenda. commissioner walker: exactly. president murphy: i think where the department can really help here is notifying the homeowners and property owners and get them involved. i don't see very many of them involved. granted i haven't been to a lot of the capss meetings, but what i see in there is great people, mostly engineers and experts in the field. but we do have to get the property owners involved if we are going to have -- if we are going to take this forward. commissioner walker: we have had the small apartment owners, building owners and managers. we have had ongoing and constant representation from these organizations representing, as well as building owners themselves, at all of these conversations. so i think that -- president murphy: i don't s

long-standing compliance issues that have been raised in the start treaty's joint compliance and inspection commission remain unresolved. defense. i am also concerned that proposals under the new start treaty may restrict u.s. missile defense capabilities which could threaten our national security. now, mr. president, of all the concerns that have been raised, i think this is the most important. it also is part of the amendment that we are going to consider this afternoon. russia and the united states each issued unilateral statements when they signed new start that clarified their position on the relationship between start and missile defenses. the official russian statement said the treaty can operate and be viable only if the united states refrains from developing its missile capabilities quantitatively or qualitatively. contrary to claims by the obama administration that missile defense will not be negatively impacted, a review of the text of the treaty shows otherwise. the most obvious limitation on missile defense is found in article 5, paragraph 3, of the treaty. this -- it says this prevents c

we had the start treaty's joint compliance and inspection commission. that commission reported -- they actually had two reports. one report was in 2005, one in 2010. the report in 2005 that was on biological weapons convention in the state department concluded, and i'm quoting from the report of 2005, russia maintains a mature offensive biological weapons program, and that is its nature and status have not changed. that was after it had been in force for five years. that was 2005. in 2010, that same commission comes back and the report states russia's confidence building measure declarations since 1992 have not satisfactorily documented whether its biological weapon program was terminated. again, so we have the biological weapons program that is reported in 2005 and 2010, saying that the program is not -- they're not complying with. in other words, they are cheating. that's -- if you sign an agreement, then you're cheating. that makes sense. chemical weapons, same thing. 2005, the state department assessed that russia is in violation of its chemical wea
