here's our senior investigative reporter aaron katersky tonight. >> reporter: tonight, ivanka trump is on notice. she will have to testify next week in the civil fraud case that accuses her father, two of her brothers and the trump family real estate business of inflating the former president's net worth by as much as two billion dollars. she tried to get out of it but judge arthur engoron said today he wants to see ivanka trump in person. even though she's no longer a defendant in the case, new york attorney general letitia james said ivanka trump "has personal knowledge of facts" and "remains financially and professionally intertwined with the trump organization." her lawyers said the testimony was only meant to "harass and burden president trump's daughter" but the judge was not swayed. so, she and her oldest brothers, don jr. and eric trump, are now expected to testify next week before former president trump is called as the state's last witness. today, trump's lawyers paid $15,000 in fines the judge imposed after ruling trump violated a gag order prohibiting public statements agai

they got to the civil trial in the first place and the argument that they were inflated. >> and ivanka trump is in a little different of a category? >> well, she is no longer a defendant, but the appeals court ruled in her favor to take her off as a defendant, because she left trump oregon when he went into office, and so she had no part of the discussions that were had about evaluating the properties, and so she is no longer a defendant, but the state basically said, listen, she still benefits from trump oregon and get -- from trump or and so she could testify after her father. >> so donald trump, himself, as soon as monday? >> yes, and the schedule could shift, and the two sons could be on the stand for quite a bit, but he is expected to be on the stand and be the final witness for the state before we head to the defense. he is not going to be in the courtroom for the children. >> he is not? >> no, he was there for michael cohen and the start of the trial, but he has some campaign things going on and so apparently not in the courtroom, but that could change, but as for now, he is not going

and that is why i think ivanka trump's bid to not be called as a witness is going to fail. s the primary contact until 2017 for the trump organization's largest lender, deutsche bank. she worked to save her father as much as 100 and $50 million on 400 million in three loans. she worked to secure really low interest rates. and so, the new york a.g. is going to want to ask her, how did you do that? and part of the way that she did that was providing these statements of financial condition to the bank. and those statements of financial condition have already been found by the court to be fraudulent. so, you know, the new york a.g. is going to want to ask questions about, you know, what was ivanka trump telling the bank when she was providing this information? what was she saying about donald trump's net worth? those are going to be really important details and potentially incredibly damaging to both her father and potentially her brothers. so, it is important testimony and i do anticipate she will be compelled to testify. >> yeah, but thinking about this. i mean, it's like a sc

ivanka trump's brothers donald trump jr.nd eric trump will testify again as soon as tomorrow. let's bring in our legal analyst, former ambassador norm isaac to join us. norm, what does the attorney general's team want to get out of donald trump's children? >> john, he wants to get out of donald trump's children additional admissions that they engaged in the falsification of business records, issuing false financial statements, and insurance fraud. now they're not going to say, yes, i did it, but what he's going to do -- what the lawyers for the ag are going to do are confront them with the inexplicable discrepancies in the valuation of specific properties ranging from trump's apartment to the seven springs estate to 40 wall street to show that there was in a nutshell, fraud. >> norm, can they avoid doing damage to their dad? >> well, they're in a very tough spot because the discrepancies between these numbers, sometimes variations on these properties of hundreds of millions of dollars in the internal records of the trump org

and that picture you just showed, nicolle, of the trump sons and ivanka and trump all testifying isllyamilies who commit fraud together end up inourt toge and that sure looks like what is going to happen. ivanka is going to try and appeal this as istand it. her claim is that she's outside the jurisdiction of the state of new york and so new york has no sovereignty over her. that is weak claim at best as the judge today found she's totally intertwined with the trump organization. she's happy to take the profits from the trump organization when they sell a hotel. she's happy to take lawyers fees from the trump organization. she's happy to have the trump organization buy her insurance including her worker's comp insurance, so the idea she has nothing to do with the trump organization which is based in new york is i think pretty fanciful. to me i look at this as just another example of the trump m.o., which is it's not just a grift of intimidation and obfuscation. it's the law doesn't apply to us mentality, you can't touch us. and i think the judge rightly said that was poppycock. >> barba

you know ivanka from your time in the trump white house.her interactions during that time and what might be weigh in on her mind with that court date on friday? >> even someone in the west wing who's definitely hands on when she advantageous to her. a problem would arise, her and so it would be nowhere and somehow they were not in the of. i think in this particular situation. she definitely is not thrilled about having to testify because we have seen her trying to distance herself, her and jared kushner or not part of the 2024 campaign. they're really nowhere to be found. and like i said, and they're very hands on previously. but they have since tried to pull away and rebrand somewhat. and so, i imagine her being dragged back into one of the former presidents legal battles. it's not a situation that she is thrilled about being part of. and i think that she does have valuable testimony to get, though, while her brother's probably play a bigger part in their roles on the trump organization and being more hands on with the day-to-day business

how much do you think that ivanka, who donald trump has talked about her like he's kind of married to her, which is kind of creepy and gross. how much do you think her testimony destabilizes him? >> you know, he prizes ivanka. i think he sees her as a sort of aryan trope he can parade around and it represents what he thinks is the best of his own gene pool. he's been over the years embarrassed by his boys, to a certain extent, both of the boys are fence posts, and he hasn't really ever had the same pride in them that he's taken in ivanka. and i think she over the years has made sure to stay in his good graces, while not going completely off the reservation in any way. but she's osnever been as robustly in his corner and as completely maga as the boys are. and what you have here now, i think it's interesting that her testimony now has been delayed to come after his, because she's going to have to listen to what the boys say and find out what the boys say, and then what her father says, and then there's going to be documents. i think the prosecutors are going to paint her into a corner
