so kaitlan, how is special counsel jack smith retailers this indictment against trump? >> well, alex, their pairing it down so they can keep it alive to try to take this case against donald trump to trial. they're focusing on what donald trump was doing after the the election as a candidate for office, rather than things he was doing when he had his presidential hat on either getting briefings speaking within the white house, talking to senior executive branch advisers, and instead, now the case is it's all about candidate trump talking with his campaign, being told by his campaign that there was no fraud and the election, that he should have known that. and then using private people, private attorneys, private advisers to try and spread election lies. get mike pence than the vice president to block the certification of the election. now, they have to walk a fine line here though, because pence was his vice president, but he's still part of this case. alex and the justice department says the donald trump had no official responsibilities related to the certification proc

>> i thought that was really a good argument that jack smith's team made.d it's the sort of argument that doesn't get a lot of traction necessarily in the district court, which is so concerned about the case in front of it, but it gets a lot of play in the higher courts because they're thinking about how expansive is this ruling if we do this? how impactful is this going to be? the notion that inferior officers cannot be appointed to do things that are even semi independent across the federal government would be a disaster. as you said in all of these departments, you have inferior officers who are appointed pursuant to these statutes without having to be affirmed by confirmed by the senate. and so it's not just a special counsel jack smith problem is not just a doj problem. if the 11th circuit and ultimately the supreme court does what trump wants them to do. it's an entire executive branch problem. so i think that was a good argument and i think the 11th circuit will consider there that seriously. >> all right. jen rodgers. thank you. up next right here o

jack smith didn't ask for that today. that is not surprising to me.when i was at the justice apartment, my role in the solicitor general's office was to solicit requests from prosecutors and uniformly say we are not going to do that. we don't ever, we have too many cases before too many judges. whenever single a judge out. it is the rarest thing ever to try to seek a judges removal. sometimes courts will do it on their own, including appeals court. that very well may have been here but that is not something that smith is going to ask for. you have to get the solicitor general's approval and i suspect he wouldn't ask for something like that. and october hearing by the supreme court. if they hear the case, my gut feeling would be they wouldn't hear the case but this thing will fizzle at the end of, it will be one vote with justice thomas but i don't see other votes for it. i think this would be the end of the road sometime in the winter or spring coming up. >> neal katyal and andrew weissman, great to have you back. thank you very much for starting off

jack smith is a very hardcharging prosecutor.hat he wanted to actually meet this deadline and not ask for more time, but the department of justice is a very large place with a lot of moving pieces and a lot of people with a lot of different equities and how to handle this supreme court decision in merrick garland, the attorney general, is a very thoughtful and very cautious person, and i suspect it probably was a bit of a tug-of-war as to how to handle this in the timing. here's the big picture, though. the downside of the delay is that to the extent the people think there could be a hearing, a factual hearing where we hear from witnesses, the more there is a delay, the less likely that's going to happen before the election. >> so then andrew, let me get your take on this tweet from george washington university law professor randall eliasson who tweeted, could he, meaning jack smith, need more time because he is preparing a superseding indictment adding trumps co-conspirators as defendants? that would be smart. what do you think

this 36 page superseding indictment from special counsel jack jack smith is clearly evidence of that the special counsel getting a new grand jury to hand up the indictment, one that had not previously heard evidence in this case, smith's team charging the former president with the exact same charges initially brought against them, though this indictment did have to be reworked to comply with the ruling smith specifically makes reference to that the supreme court ruled trump can claim immunity from prosecution for some of his official actions while in office. so prosecutors have now cut language about trump's interactions with government officials and added language to describe when he was acting, as a candidate and not president. and as you might imagine there's been donald trump is fuming about all of this claiming it as an attempt to interfere with the 2024 election will also falsely and baselessly claiming vice president harris is actively behind it and he goes on to accuse her of weaponizing the system against her political opponents, which she is not doing joining us now cnn sen
