let's get to jackie ward live in san francisco with more on this problem. jackie? >> reporter: michelle, the hoa attorney tells us that building engineers do plan on fixing this second cracked window today. we are not sure when. but we can see it from the street. let's show you what we're talking about. we are looking now on the fremont side of the building through these branches, you can kind of see it. it's being held together with duct tape. the department of building inspections has given engineers until friday to fix it. so the cracked window is between the ninth and ten floors on fremont street. it's the outside pane of a double paned window. inspectors discovered this crack last week. you may remember that just last month, the first cracked window was found on the 36th floor. the city says the notorious sinking and leaning problems of this tower are not what caused the first windows to crack. it's unclear what caused this second one to split. the building sunk a foot and a half since opening in 2009. so this second cracked window should be fixed sometime tod
