, evacuations and a major disruption for the morning commute in just a minute but we begin with jackie ward with the latest on the conditions right now. jackie? >> reporter: let me take you for a little walk and show you what sidewalks in san jose look like right now. completely flooded. you can see cars are taking the corner here at 26th and santa clara, that they have to get through at least a foot of water. at least that's what i think it is judging by how high the water is getting on my boots. this is the kind of flooding people are dealing with and have been dealing with. we are in the heart of the evacuation area. coyote creek is to blame for this. the runoff peak has been reached at edenvale where water levels continue to recede and aren't expected to drop below flood levels until wednesday evening. however, flood waters through the streets of san jose and mill milpitas. though people new of the flooding potential, it all happened really fast. >> water started coming in and then it came in more and more and more and then finally the fire department showed up, told us that everyone ha

in san jose, jacky ward, kpix5. >> where jacky ward is standing we have a flood warning that remains in effect for this lunch hour. it is for the coyote creek and san jose area. as you see that red highlighted area it's about 63 miles wide as far as that creek is concerned more like a river. and it streams through the san jose and morgan hill where the flooding is still occurring. we do have a little bit of relief this afternoon as the waters begin to recede. right now standing at 10.5. flood stage is at 10 feet. in the north bay area still sustaining flooding right now. we do have blue skies and dry conditions. but we also have a thin vail of cloudiness over the past two days, look at these rainfall totals. this is why we have the problems we're experiencing right now. san jose that's a lot of rain over a two-day period for you. same in the livermore area where we've seen golf courses inundated with precipitation. and 3 inches in san rafael. we have blue skies right now and a break in the activity. but i'm tracking a brand new storm heading this way. i'll tell you when to expect it

jackie ward is live at the santa cruz sum it it show us how conditions are now, jackie. >> reporter:e're sort of on standby right now. there are no major mudslides or landslides to report. the only thing that may snarl up traffic that has been causing delays for a week now is that vine hill road exit mud slide. and we have seen chp crews out there removing trees and taking care of debris as much as they can. one lane is open in that area. fortunately, it's a holiday today, though, and as we can see behind me, there are a few cars and not terrible amounts for rush hour. this area from highway 17, trying to get to cupertino and other places on the peninsula, this has been a pain in the neck for commuters. i spoke to commuters all winter long and it's one of those things where it's very hit or miss. they have to check chp updates to make sure that they can drive home. last time i was here, i was actually able to stand in the middle of the highway during the evening rush hour. guess i can check that off the bucket list. that is a taste of what the commuters are doing. ing to to report so

jackie ward, kpix 5. >>> the russian river crested today for the second time this week. the river has crested above flood stage but not as high as previously thought. kpix 5's anne makovec is in the flood zone. >> reporter: the russian river crested almost 2.5 feet above flood stage this afternoon. along the banks of the russian river, and the adjoining creek, the resort town of guerneville is flooded again. >> the level of the water, an ambulance wouldn't clear through. >> reporter: which is why the national guard is on standby to help anyone trapped in their homes. their armored vehicle can navigate through water more than 4 feet deep. more conveniently than a boat. >> the way to get in and out. >> reporter: here's an example of how deep the floodwaters are. this is in a low-lying area but normally that hole in that plastic tree that's the entrance to this mini golf course. normally, you can walk through there. so the boats are back as a means of street transportation. but the water has been higher. here's what it looked like on january 11 when the river crested at alm

jackie ward is live in our newsroom on their push to change current safety rules. jackie. >> reporter: major car makers say they need these regulations to change in order to test more cars and get them on the road faster. the department of transportation can exempt up to 2500 rules a year. car makers argue that won't always be the case. this bipartisan effort is the first major attempt to address the issue in congress. in september the obama administration unvailed guidance to states and auto makers on self-driving cars. and many if november car companies urged the trump administration to view the guidance which hasn't taken effect yet. auto makers are concerned about states moving ahead with their own regulations. a hearing is set for this afternoon. in the newsroom jackie ward kpix 5. >>> the trump presidency is not yet a month old. >> but there are already top level shakeups to assess. for more, we turn to mark. >> reporter: average national security advisor lasts about 963 days. this one lasted less than 30. what is amazing about this is we're not sure whether o

jackie ward joins us with more. >> reporter: last year was the first full year we saw detailed data of these incidents and the examiner is reporting that numbers have remained steady over that time. data also continues to prove african-americans and latinos are more often impacted their mother ethnic groups. the examiner writes the new report details all use of force incidents and the race and gender of those involved. the department of police accountability says all the cities like san diego and oakland have seen a decline in reported police misconduct since introducing body cams, it may be too soon to tell in san francisco because fourth- quarter data has yet to be released although there was an increase over reported incidents. the report called that a "minor difference. there were 45 more encounters deemed use of force incidents in the fourth quarter then there were in the third quarter. as far as ethnicity of the subjects, the report says there was a big drop, 194 african- americans in the fourth compared to 448 in the third. >> thanks. >>> president donald trump and canada's prim
