[loud noises] [inaudible] >> reporter: there are protesters -- [inaudible] the demonstrators are -- a lot going on out here. [inaudible] [inaudible] >> reporter: the protesters turned the corner at 19th,. [inaudible] we heard loud noises -- [inaudible] to bring their tents into the other areas out here. [inaudible] >>> obviously we're having some audio problems with jade hernandez, essentially what is happening is the occupy protesters had vowed to take over an empty lot there at 19th and telegraph, you can see by the pictures they already set up tents in the area. that is what they said they would do. the fence was placed earlier by police, but the fence has been torn down. some of the neighbors that live in that area say they didn't want the occupy protesters there. starting a facebook page. they planned to link arms, tried to surround the area to protect it from the campers. but that did not work. we'll try to check in with jade later to see what is happening there. >>> and tonight

jades hernandez live for us, what's happening now alex? >> reporter: this crowd just significantly in the last five minutes we saw a large contingent of student protesters make their way here. and as you can see they're making a lot of noise. carrying this large banner that says our space. and they were carrying floating tents as well. and saying they do plan to set tents back here back up here on the steps of the hall after the police action that occurred overnight where officers came in and swept out an encampment. there's a lot of anger and frustration from folks here. many people we talked to said they are determined to set tents up back here on the cal campus. what they say would be a symbol of defiance. >> demand all those at sprawl hall to immediately disperse. >> reporter: the surprise raid on occupy cal came at 3:30 this morning. police officers got help from near by agencies as they cleared out about 20 tents that had been set up on the steps of sprawl hall. >> just swarmed the place, there were no 10 minute warning or nothing. >

ktvu's jade hernandez is live with why officers are being quit about the investigation. >> reporter: i just learned the police chief issued a gag order. they don't want to jeopardize the prosecution. we were inside the court and we watched as henry albert smith's family members entered the courtroom. he is accused of shooting and killing james capoot. i don't know wanted to speak -- no one wanted to speak to us. smith did not enter a plea. they filed a motion to exclude media coverage, arguing it puts smith's safety at risk. james capoot died last thursday after responding to a bank robbery at a bank of america. the da is saying smith, who robbed the blank is a fell 1 a strike against him after defined under the three strike's law. they added a first degree murder charge against smith lay in wait for james capoot as he chased him. smith shot james capoot several times before they used a taser to take him into custody. "jack andjames capoot died at the hospital. smith is expected in court on the 29th 29th. james capoot is scheduled for wednesday. he leaves behind three daughters and a

ktvu's jade hernandez is live where protesters just finished meeting. >> reporter: "occupy oakland" just held a press conference to say why they are holding a strike and mass day of action. it began 45 minutes ago. and anyone within the group who wanted to speak was allowed. it was health at telegraph and broadway because it was the site of the last strike in 1946. the movement has four points they are stressing called for wednesday. solidary, to end police attacks on the community, defend oakland schools. one protester held up a victory from city hall today. >> i have a memorandum in which she says the sciu approached them and asked them to let their workers off for the day on november 2 and in response to that she says that any worker who chooses to take part will not face action from the city. >> this is a movement about fighting corporate rule. >> reporter: you are looking at "occupy oakland" right now here in front of city hall. that is a man who supports the cause but they won't instruct members to strike. coming up at 6:00, how local labor unions are handling the strike. i want to

live, jade hernandez, ktvu channel 2 news. >>> police arrested a san francisco man on attempted murder charges after he shot and wounded his sister last night in san francisco. investigators say he was upset over family issues and might have been high. he took several family members hostage and fired at his sister hitting her. police arrested him after midnight. >>> hundreds of people lined lined the streets this afternoon to show their support for the family of a marine killed in afghanistan. officials say 19-year-old james -- joshua corral was killed. he was based in 29 palms. this is him and his mother. he joined the military after graduating last year. the family went to dover air force base where his body was flown. they are met with hundreds of people lining the streets of their home. a vigil is planned for tomorrow in danville. >>> an incredible rescue after a car crashed and caught fire with the driver inside. it happened 1:30 this morning between 12 and 13. ktvu's >> reporter: seconds before the car burst into flames three strangers freed a man trapped inside. >> the gasoline

"the outpouring of love and support from the entire community has been incredible and greatly appreciated." the 45-year-old was shot and killed during thursday's pursuit of a bank robbery suspect after a bank of america was robbed around 1:30 in the afternoon. vallejo officers eventually arrested the suspect, 37-year- oldd henry smith of fairfield. the vigil is organized by fighting back partnership and church on the hill. the capoot family is asking the community tonight to say thank you to any officer that community members might see tonight. that is an honorthat is in honor of james. repo

reporting live in oakland, jade hernandez, ktvu channel 2 news. >>> a handful of protesters remained at the port of oakland. a ktvu news crew took these pictures just before 6:00 a.m. you can see demonstrators urging port workers to turn around. there were some tense moments when protesters used metal fencing to try to block the drivers. port officials say the port was back open after a few hours. >>> protesters released a letter for mayor quan. the vandalism, business losses and general fear is not an acceptable condition for our great city. what is your plan? >>> today oakland police blamed a splinter group for the overnight vandalism. officers fired tear gas to disperse protesters who broke into a vacant building and set fires in the street around 16th and broadway. police say in all they arrested 101 people after midnight. 25 women, 76 men. 32 are from oakland, 46 are from other bay area cities. most of the protesters were arrested for misdemeanor unlawful assembly. one man from elk grove is facing felony vandalism charges and an oakland man was arrested on assault with a deadly

jade hernandez, ktvu channel 2 news. >>> back now to the breaking news. the shooting we just talked about a moment ago at 14th and broadway. that is essentially right next to the occupy oakland camp site. janine de la vega is on the phone with us now, janine what happened. >> reporter: i would say 10 minutes ago we were in the truck preparing to go on the air and suddenly we heard pan, pan, pan, pan. several gunshots. at first we did not know if they were fire crackers. we saw a group of people running. when we started heading that way, we saw people crying, we saw people running away. we saw people worried. now i'm standing in front of where i see a man down. he is on the ground right now. there's a group of firefighters and police. cpr is being performed on him. i'm told by witnesses here that he was shot. that supposedly the perpetrators ran away but there's been a group of occupy protesters sort of circling around him sort of linking a human chain. they don't want any video cameras any time they see anybody hold up a cell phone to take video of this v
