i'm jake tapper.ndictment of a former president of the united states. it was unsealed just this afternoon. it contains 37 charges against donald trump. the document alleges that mr. trump kept documents so sensitive they required special handling, and the handling was -- well, let's say not so special. storage locations for documents on u.s. defense, nuclear programs, and more, in the insecure mar-a-lago facility include in a bathroom, on a stage, in a shower, in a ballroom where public events were held. the indictment also alleges that trump showed these documents to at least one person and asked his attorney to lie to the federal government about possessing these classified documents or to hide or destroy the documents that had been subpoenaed. specifically says on at least two occasions trump shared the classified material to others who didn't have the clearance to see them. this afternoon, special counsel jack smith made his first ever remarks on the trump indictment plainly stating that no one, n

and the sensitivity, jake. and the sensitive, jake.documents that was highlighted in this indictment, document 17. it talks about the military capabilities of a foreign country. it's tabled top secret. you can see it right there. it's highlighted, redacted. what that is, i'm told my intelligence professionals, is that this was so sensitive that you needed a code word to get that clearance. it is code word classified. that is among the most sensitive intelligence that this country has. it reduces the pool of people who can have access to it to a small number. you can see no foreign on there. that means no foreign nationals, can look at this intelligence. no partners. no one from some of our closest allies, great britain, australia, the europeans, anything like that. so, this is major concern about what is the sensitivity there. and it's just worth highlighting, jake, that this comes on the heels of those massive leaks of jack -- the first class airman in cape cod. in that case, we saw the documents that were exposed and it showed how se

>> no, not at all, jake. getting 400 years in this case or 40 years or anything close to it. the way he gets that number is if you take the maximum allowable sentences for all 37 charges in this case and you add them up, it does come out to 400. however, nobody is getting the maximum in a case like this. you have to look at the federal sentencing guidelines, which are influential, the judge has to consider them, but they're not binding. if you run that calculation, this case comes out pretty high, to about 8 to 12 years. now, the judge can go above that, which seems unlikely to me. the judge can go below that, but, jake, this seems to me to be no matter what, even if the judge goes below the 8 to 12 year range, it is hard to see a judge going down to probation, to no sentence. this seems to me if there is a conviction like it is very likely to be a prison sentence of some sort, maybe not eight to ten to 12 years, not 400 years. >> that's a claim grounded in some sort of foundation of reality, though. if you a

>> that is right, jake. the former president took a seat at the defendant's table, and he was wearing trademark red tie with the dark suit. he had a very serious look on his face, and periodically had his arms folded and once in a while would speak to one of his attorneys todd blanche who is the lawyer who stood before the judge when he was asked to enter the plea, he said, we most certainly enter a plea not guilty, your honor. that was essentially near the beginning of the hearing. these hearings are very perfunctory and short, and we got there very quickly. before the president entered room, 30 or 40 minutes before the judge, and we could not see exactly when he entered the room, because the televisions of the room that we were in were not turned on immediately, but we saw, you know, the lawyers take their seats and the former president sort of twiddling his thumbs while he waited for proceedings to take place, and he never looked around the room, and he had a very glum look on his face, and periodically j

jake? >> yeah. hearing rhetoric coming from the president, some members of congress, some of his allies. how is that rhetoric, the online bluster how is it impacting the law enforcement reaction? >> reporter: well, a law enforcement agents across south florida are taking that into account. in conversations i had with folks within tmiami-dade police department they told me they were aware of the social media posts and keeping an eye on the rhetoric being used. over the weekend the former republican candidate for governor in arizona kari lake made comments about the indictment that have brought a great deal of criticism her way for some of the language she used. here's a portion of what they said over the weekend. >> we're at war, people. you want to get to president trump, you have to go through me and you're going to have to go through 75 million americans just like me. and i'm going to tell you, yep, most of us are card carrying members of the nra. >> and so, jake, the miami-dade police department

>> jake, that is probably my principal concern right now. some of the rhetoric we've heard over the last couple days has been over the top, dangerously irresponsible. some of these extremists in public life seek to outdo each other. that kind of rhetoric makes unacceptable behavior acceptable and, frankly, violence inevitable. i can understand the impulse of some of our leaders, some of our rational leaders to avoid engaging and responding to this kind of thing, but i do think there comes a responsibility, frankly, by federal officials who lead federal law enforcement to really speak out against this and call it out and say to those who are engaging in this kind of dangerous rhetoric, if somebody gets hurt, we are going to, within the fullest extent of the law, seek to hold you responsible. it is a federal crime to threaten a federal official in the conduct of their office. it is a federal crime to incite an veinsurrection. we've got to look to jot just the proud boys and those who might be on the ground in miami-dade tomorrow, but also thos
