now the fbi director james comey says that error was on the fbi.n the feds, a mistake, it never should have happened. what did happen what went wrong, why did got so wrong? and does this point up something that is wrong with the system broadly or a one-time unbelievably tragic failure? joining us is kerry johnson for npr, one of the reporters summoned today. it's nice to have you. thanks for your time. >> thank you. it's a pleasure to be here. >> what was the error that jim comey gave this for? what went wrong at what level? >> somebody goes to a federally licensed firearms dealer they fill out background information and within three business days the gun dealer is supposed to be able to know whether it's okay to sell the weapon to that person. what happened here according to the fbi director was a series of errors among the federal government and some on the state or local government. first of all dylann roof's arrest record from late february or early march of this year did not contain at least initially, the proper or accurate arresting agency.

amy: that is fbi director james comey. your response. e: he said that, but when we hear these arguments we do not get examples. we found that it was only in four cases. comey is not able to give examples of iphones being encrypted. he gave some examples that were refuted. we get scare stories, but we do not get credible evidence this is hindering law enforcement. it turns out we have a lot of that at that is not encrypted and cannot be encrypted. facebook, e-mail, conversations location data on our cell phone -- this is the golden age of surveillance and a lot of the stuff could be used against us. remember apple took photos from servers that were leaked, rising photos of celebrities. this is how the data is being stored. the fact that some stuff is being put on phones communication is secure -- that is not a hindrance to him. he says it is, but they are scare stories. we heard this before. in the mid-1990's we have the same debate and most of us released a report in the mid-1990's saying the same thing. here we are 20 years later, and th

i suppose it's possible to be hearing from james comey, as well. again, the fbi is the lead agency on this and our reporters have talked to the uniqueness of this. that the feds would take over such a matter so very quickly. chattanooga law enforcement officials and hamilton county as well there, were on scene at the first scene within a minute or two it's our understanding. at the same time, the suspect had been making the drive to the north and west to the second location along the tennessee river at the park there where hee aim at yet another military center and it was there we're told by authorities that the four marines were shot and killed. it's stale little murky to us exactly what the transpiring of events was that led to the death of the shooter. but here's what we believe happened. the witnesses on scene have told us that the shooting went on there for many minutes. the witnesses have estimated somewhere between 15 and 20 minutes. so all of this shooting was happening. back and forth. not as rapid fire at the end but certainly the shootin

"this case rips all of our hearts out but the thought that an error on our part is connected to a gun this person used to slaughter these people is very painful to us." when he says error on our part what he's talking about is about the charleston south carolina church massacre. the young man on trial, four months before the murder he was arrested for illegal drug possession. he did not have a prescription for the drug. he was arrested and charged for possessing it. under federal law, no one who is an unlawful user of any controlled substance is supposed to be able to buy a gun. there's lots of ways around that. going to a federally licensed firearms dealer isn't a way around it. two months after
