melissa: here now, james freeman from the "wall street journal," also a fox news contributor. james, give me your opening thoughts first on all of that. >> yeah. it's the flip of a coin. there's a case here that congress has given the president a lot of authority. you have talked about this 1976 law. the presidents over the years have declared lots of emergencies. usually in this case, congress has authorized wall building but not for this particular amount that he's seeking. i think it's possible the state attorneys genuieral win in the first round in california. that's why they filed there. long-term as it goes higher in the judicial system, i think the president has a shot. melissa: the president laid out pretty clearly that he thought it was going to go all the way to the supreme court and that he thought he was going to be able to prevail at that level. what do you think? >> yeah, when we look at presidents, obviously president truman didn't do well claiming the ability to nationalize the steel industry but this is something that i think most people would recognize is more

joining me to break it down, dagen mcdowell, james freeman, fox business contributor robert wolf.ee you this morning. >> great first hour. maria: thanks for being here. >> it flew. maria: it did. the show flies by. >> there's a lot going on. maria: we've got the federal reserve on tap, jay powell testifying to the senate today, the house tomorrow and you've got the north korean summit as well. dagen: and then what to make of the home depot earnings, i think. take a look at those, stock in premarket trading. i think it was up about 10% year-to-date before this earnings announcement, which would be under-performing the blue chips ever so slightly, down 2% right now. one of the problems is, it missed on same store sales increases, same store sales at u.s. stores up 3.7% in the fourth quarter and that was short of analyst expectations of 4.5%. but 3.7% in same store sales growth, that's pretty good. maria: i saw that number and i thought wait a second, what was the estimate, 3.7%, that's not bad. dagen: with continue crease in the quarterly dividend, it's a 32% increase in the quarter
