cnn special correspondent jamie gangel has that story and joins us now. jamie, tell us about the gaps in these phone records. >> so, john, just to be clear, as maggie just mentioned, there is no evidence. no one is suggesting that someone tampered with these logs. when they talk about gaps, what they are saying is there is a distinct period of time during the day on january 6th during the riot. those three-plus hours where trump is back at the white house watching the reporting, is transfixed watching the television. that's where the logs are odd. it is notable. it is significant that, during this period of time, the white house' logs do not appear to show that made any calls out or any calls came in. these are people he actually would have spoken to. now, what does this mean? as maggie mentioned, trump, we have always known -- first of all, he likes to use his own personal cell phone. so that would not be in the logs. he very often uses the cell phone of a staffer, maybe dan scavino. maybe, his personal aide. the other possibility is that the archives do

joining us now, maryland congressman, jamie raskin.tion, and former impeachment manager for donald trump's second impeachment. thanks for being with us. we appreciate your time. liz cheney, your republican colleague, who is on the committee, one of only two republicans on the committee, has said that they will -- your investigation will prove that donald trump's lies motivated the violence on january 6th. what does that do? what happens if she is right, and you are right, and you have the proof? does it change anyone's mind about anything? >> well, our mandate, of course, is to get to the bottom of the events. to tell america the truth, so people can see the clear chronology of events and the causation of different things. of course, the house already impeach donald trump for inciting the violent insurrection against the union. there was a 57 to 43 vote, the senate also agreeing to that factual causation. but, what we're doing here, we're filling in, with very empirically rooted fine grain detail, exactly what took place. who spoke to

joining us now, democratic congressman jamie raskin of maryland.s a member the january six committee, and served as the lead impeachment manager in the second impeachment trial of donald trump. he is the author of the new best selling book, unthinkable. congressman, thank you very much for joining us tonight. what can you tell us about this gap, or what's happening, and what's your finding in the records of the trump phone calls on january 6th? >> well, not much, other than everyone is very curious about it, it raises more questions than answers. i know that there are a lot of minds left immediately to rosemary woods, in the 18 minutes deleted watergate tapes. but it could just as well have been donald trump using a personal cell phone, or someone else's cell phone, to communicate with senators, with representatives and with other people out on the street. so we just don't know what it means at this point. >> and by the way, you said most of those phones, almost all of them, possible except the president's official cell phone, are not secure commun

"the post" says that donald trump was warned about tearing up documents by two chiefs of staff, and maybe also the white house counsel. so, could he be in legal jeopardy here? >> well, i think the only way he could be in legal jeopardy is if someone could prove -- if the justice department can prove he was tearing up documents in order to avoid disclosure to a specific investigation. if he just did that as a matter of course, or if he did it just, um, in violation of the presidential records act, that is not a criminal violation. in order to be a criminal violation, you have to look at his intent. and only if his intent was to make sure those documents didn't get into the hands of investigators, whether it was robert mueller earlier or the -- the congressional investigators later, that's the o

so, jamie, what more do we know about mark short testifying?ery significant because he is a firsthand witness. he was in the room when -- when former-president trump was pressuring mike pence. mark short was in the oval office. he heard everything that was said when, on january 6th, he was at the capitol with mike pence when people were chanting "hang mike pence." he had to evacuate with him. he is someone who can speak to the committee, and tell them exactly what was said. and i think one of the critical things that we learned is that when he went to testify to the committee, let's remember, it was under subpoena and the documents he handed over were under subpoena. but i'm told he spoke to the committee at length, and while many of the interviews have been done virtually because of covid, mark short went in person to do his testimony. >> um, that's fascinating. uh, the -- do we -- do we know why he went in person? >> we don't. but i think that there's no question -- look. we know if someone -- a witness -- comes in person, it has a different
