joining us is now jamie weinstein. thank you for joining us. with those accusations, accusations it had in fact criminalized journalism that related to fox news very own james rosen who was named as a criminal co-conspirator says the doj could have access to his records, his telephone records specifically and email. so what about these new guidelines. i understand there are five of them. how have they changed and what are the changes? >> i think there is two really big ones here. one of them from my reading would prevent something what happened to james rosen from happening again. they could not, justice department could not, charge a journalist as co-conspirator in crime for merely performing news gathering activities in order to get a subpoena for a leak investigation. it looks to me it would prevent a future james rosen situation from happening again. the other big one i think people are pointing to, is the government would have to notify in most cases news organizations if they are going to subpoena records of a reporter. that would give th

joining me now, jamie weinstein, senior editor of the daily caller. quite a bit to discuss, jamie. good morn. first on the irs employees, it's interesting. they're the agency that's supposed to enforce and implement the whole obama care program. they're complaining and two other unions are. unions that have been for the most part very supportive of anything president obama wants. what do you think the chances are that their push to actually change provisions stopping it altogether? >> i don't know if it will stop the exchanges altogether. certainly it's kind of a pr blow for the obama care exchanges. if even the own employees of the federal government are afraid to go to these exchanges because they don't want to lose the current coverage they have, what does that say to other americans who are going to be going into these exchanges. it doesn't say that this is a great program here to get health care. >> you know, what they're saying actually is they're calling it that it will bring nightmare scenarios and take away their well earned health benefits. are we headed for a showdown? >

jamie weinstein, editor at daily caller. e, polls show nothing else has convinced that the public thinks the affordable care act is the next greatest thing since sliced bread. will this work? >> they hope it will. the individual exchanges and state exchanges open in october and what the president needs to make his bill workable, the young and healthy need to buy in so they can subsidize the sick and the elderly. that will be a tall task. they will have to pay maybe two, or three times the cost they would have to pay before obamacare for these health insurance plans. they're hoping they can do whatever they can, like get celebrities involved. maybe make will ferrell do a few comic skits to do young and healthy people to buy in. otherwise it could be a crushing blow to obamacare if you do not have the young and healthy demographic buy in on these health plans. >> the long history, jamie, as i'm sure you know, of various administrations enlisting help of hollywood, dating back to selling war bond during world war ii. celebrities

to jamie weinstein who says for good reason, there is a higher authority than a freaking beer instituteo you make of this? >> i think the whole commercial is a little tacky and cheap. if you're going to invoke the declaration of independence, at least invoke it our. our creator part is a very part of the declaration. it shows they're endowed not by some government, not by some metaphysical, it's in the air out there. but by a higher power, by god and can't be taken away. on the other hand, i understand their point, they don't want to invoke god. i could see them being criticized invoking god to sell beer. if you are going to use the declaration of independence, use it right, i think so people can understand exactly what it means. >>> you're on a slippery slope when you use the declaration of independence to sell beer. i always think samuel adams is spinning in his grave thinking all of this for beer? but what do you make of this idea that beer, there are strict limitations on what they can and cannot say and that guys like you, maybe guys like me, focusing on this, making a big deal out
